trail would be placed on Mr. Bach's property, as part of an agreement to share the land obligation of the <br />required pedestrian access. He reported that Mr. Bach has expressed a concern with the timing of the <br />installation, in that Mr. Bach currently grazes horses on the northern part of his property and he would <br />like to continue to do so. He also advised that Mr. Bach has expressed a concern with the interface of <br />children feeding his animals and things of that nature; therefore, Mr. Bach would like to defer the <br />installation until he ultimately develops his property some time in the future. Mr. Plucker reported that <br />staff has received correspondence and a petition from some of the neighbors to the north requesting that <br />the path be installed now. He advised that in order for that to happen it would probably have to be <br />exclusively on Mr. Bozorgzad's property, resulting in additional implications. He reported that staff has <br />also received letters from Mr. Bach, a petition that was circulated earlier, and a letter from another <br />neighbor stating that they do not have a big concern with the trail installation, but that they would prefer <br />it to be deferred as well. He noted that staff is recommending concurrence with the applicant's proposal <br />to allow for the trail to be provided for, part of it to be installed, and the remainder of the trail to be <br />installed in the future. <br /> <br />Mr. Plucker advised that staff is recommending approval of the proposed development plan and design <br />guidelines, with the modifications as presented in staffs memorandum which was distributed to the <br />Planning Commission. He noted that there are two areas in which staff does not support the applicant's <br />request to modify the conditions. The first is the hours of construction. He noted that staff is <br />recommending that the construction hours be 8:00 a.m. to 5:00 p.m., Monday through Friday, excluding <br />all Federal holidays, and this would not allow weekend construction. He indicated that the applicant <br />would like to have some limited hours on the weekend. He noted that staff's recommendation is a result <br />of the complaints received because of the Greenbriar construction on Saturday. He advised that the <br />other issue is stafi~s recommendation for 20% F.A.R., excluding 600-square-feet for garages on lots 2, 3, <br />and 4. He noted that staffs recommendation would limit the future homes on lots 2 and 3 to just under <br />4,000 square feet (excluding 600 square feet for garage area), and under 7,000 square feet (excluding <br />600 square feet for the garage area) for lot 4. He reported that the applicant has requested a maximum <br />square footage of 4,000 for lots 2 and 3, and up to 7,500 square feet for lot 4. <br /> <br />Discussion ensued regarding potential grading, and the view and privacy impacts on existing neighbors; <br />the potential pathway route as presented in the North Sycamore Specific Plan; the Greenbriar <br />construction hours; easements for the path; tree mitigations; visual analysis requirements; and the side <br />yard setback recommendation. <br /> <br />Commissioner Roberts noted that she has spoken with the applicant. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />The applicant, Hoss Bozorgzad, 6546 Arlington Drive, stated that he purchased the property in 1994 <br />with the intention of building a home for his family and providing a home for his in-laws in the existing <br />home. He provided an overview of the processing of his application for a PUD over the last several <br />years. <br /> <br />Mr. Bozorgzad noted that he is requesting that the Planning Commission allow construction work on <br />Saturdays, limiting the work from 9:00 a.m. until 3:00 p.m. He would also like the Planning Director to <br /> <br />PLANNING COMMISSION MINUTES Page 12 August 25, 1999 <br /> <br /> <br />
