He <br />noted that with regard to the condition related to issuance of the building permit, Mr. Bozorgzad advised <br />that his family already lives in Pleasanton and his children are attending school here, and, therefore, he is <br />requesting that one building permit be allowed to be issued prior to the construction of the new schools. <br />In conclusion, Mr. Bozorgzad requested the Planning Commission's approval of the project so that they <br />can move ahead with grading this year, prior to the rainy season. <br /> <br />Kristi May, 5833 San Juan Way, stated that she has some concerns regarding this property. She stated <br />that when she moved into her home nine years ago, she knew about the path, and she believes that the <br />owner of this property also knew about the requirement for a path. She noted that the access of the path <br />has been negotiated back and forth. She advised that the neighbors want the path and that there are more <br />than 50 signatures on the petition that want the path. She stated that the path is needed for children to <br />get to the new Case Avenue school, the golf course, and the trails; and use of Sunol is very dangerous. <br />She stated that the pathway has always been there, it needs to be there, and she sees no reason for it to be <br />taken out. She commented that the City is saying that it wants neighborhoods connected and this is <br />consistent with what the City wants. She expressed concern with tying the construction of the path to <br />the development of the other property and stated that since the water line is going to be installed, it is <br />also a good time to construct the path. She noted that the house on the lot closest to her neighborhood is <br />a big concern. She commented that her neighborhood is going through a lot of change, the Greenbriar <br />development is really ugly, and the New Cities development is coming in right behind it. She advised <br />that the noise of Greenbriar construction is very loud and incredibly disruptive and she does not want <br />more noise added. She noted that the homes will be seen as one drives up San Carlos and she is afraid it <br />will obscure views and impair the aesthetics of the neighborhood. She commented that 7,000 square feet <br />is huge and a two-story home isn't necessary. <br /> <br />In response to a question from Chairperson Kumaran related to the water line and trail, Mr. Plucker <br />clarified that Mr. Bach is part of the application because part of the trail development is located on his <br />property, but he is opposed to installing the trail at this time. Mr. Plucker advised if he was required to <br />install the trail now, staff anticipates that he would withdraw his consent to be part of this application. <br /> <br />In response to a question from Commissioner Sullivan, Ms. Seto advised that the City could condemn <br />out the portion of the property required for a trail, but it is more cost wise to wait for the development of <br />the property. <br /> <br />Gail Olney, 5855 San Juan Way, stated that they bought their home when there was going to be a <br />development behind San Carlos and San Juan, and they were happy to see that the road wasn't going to <br />go through, but that there would be a walking path. She noted that Mr. Bozorgzad bought knowing this <br />access was on his property. She stated that she assumed the path was on Mr. Bozorgzad's property and <br />thought the path was going to connect to the Greenbriar development, and she wonders if there is still a <br />possibility for this connection. She indicated that she doesn't like waiting for when and if there is furore <br />development. She noted that Mr. Bozorgzad tried to close the access last year and they opposed it. She <br />advised that she has collected 28 more signatures, in addition to the petition she has already submitted. <br />She noted that her son has a friend on Laura Lane and for the past seven years she has been driving on <br />Sunol to take him to visit. She noted that residents on Laura Lane would like this route for their children <br />to attend school, and this would take cars of the streets and provide a more city-friendly connection.
