Z-98-287, Joseph and Maricela Barone <br />Application for design review approval of a permanent parking area for Barone's Restaurant. <br />The proposed permanent parking area would be situated on the rear portion of the site located at <br />493 St. John Street and would replace the present temporary parking area. Zoning for the <br />property is C-C (Central Commercial) District. <br /> <br />Mr. Iserson referenced a staffreport dated August 11, 1999, and highlighted key areas contained in the <br />report including project description, downtown parking lot plan, site design, parking, future tent <br />enclosures, landscaping, existing trees, grading and drainage, and the neighborhood meeting. In <br />conclusion, Mr. Iserson noted that staffs recommendation is that the Commission adopt a resolution <br />approving Case Z-98-287, subject to the conditions of approval listed in Exhibit "B." <br /> <br />Discussion ensued relating to the spillway/outfall structure that would drain into the Arroyo, the <br />encroachment permit that would be required from the Alameda Flood Control and Water Quality <br />Conservation District Zone 7, the possibility of draining onto the lawn area, where customers will park <br />during construction of the parking lot, and the setback from the edge of the parking lot to the bank of the <br />Arroyo. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Joseph and Maricela Barone, the applicants, noted that the adjacent neighbors and the Maddens were in <br />favor of the parking lot. Further, Ms. Barone noted that they were in support of the parking lot being <br />used informally for public parking; however, they would not be in favor of a formal agreement with the <br />City for use of the parking lot due to the applicants' house being adjacent to the parking lot. She noted <br />that the guest house on the property will be utilized as an office. Mr. Barone expressed concurrence <br />with stafl~s recommendations as contained in the staff report. Mr. Barone noted there will be permanent <br />plans for the parking lot by the Spring of 2000, with groundbreaking in early summer of 2000, and the <br />lot being completed by the fall of 2000, weather permitting. In response to an inquiry by Commissioner <br />Sullivan, Mr. Barone noted he would prefer the option of handling parking lot drainage by trenching <br />through the adjacent restaurant property due to the cost effectiveness of this option. He further <br />commented on the liability insurance for the property and noted he would have no objection to installing <br />a sign denoting the parking lot. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner Kameny commended the applicant for gaining the approval of the neighbors for the <br />parking lot. He noted he would not be in support of the parking lot layouts, which would eliminate the <br />grass area, gazebo, and redwood tress. He noted that the applicant has exceeded the required parking by <br />22 spaces. In conclusion, he stated he would be in support of approving the application. <br /> <br />Commissioner Roberts spoke in opposition to the grassy area being removed and stated that the green <br />area next to the Arroyo is invaluable. She noted she would be in support of approving the application if <br />a sign denoting the parking lot is installed. Further, she expressed concurrence with the applicant and <br />the neighbors in not desiring a parking contract with the City due to their adjacent residence. <br /> <br />PLANNING COMMISSION MINUTES Page 5 August 11, 1999 <br /> <br /> <br />
