- PUBLIC HEARING WAS OPENED

Joseph and Marie Ghiringhelli, the applicants, noted they would be happy to answer any questions from
the Commission.

PUBLIC HEARING WAS CLOSED

Commissioner Kameny commended the applicant for gaining the approval of the neighbors. Further, he
noted he visited Sylvaner Drive and the applicant's backyard was not visible from that site. In
conclusion, he noted he would be in favor of Monday through Friday construction.

Commissioner Roberts noted that the Monday through Saturday construction hours would shorten the
duration of the construction activity. Further, she stated that no overhead additions could be added onto
the property without encroaching on the 40-foot setback. And since there are no complaints from the
neighbors, she would be in favor of approving the application.

Commissioner Sullivan commended the applicant for his communication with the neighbors and spoke
in favor of Monday through Saturday construction hours due to the possibility of the applicants
performing the construction themselves.

PUBLIC HEARING WAS REOPENED

The applicant noted a contractor is performing the work and that the contractor's only concern was with
completing the project before inclement weather arrives. Further, the applicants state they have no
objection to a condition for Monday through Friday construction hours.

PUBLIC HEARING WAS CLOSED

Chairperson Kumaran stated that his only concern was setting a precedent for adjoining property owners,
but due to the condition that structures must be approved on a case-by-case basis by the Commission, he
would be in support of approving the application.

A motion was made by Commissioner Kameny, seconded by Commissioner Roberts, that Case
Z-99-185 be approved subject to the conditions of approval, as shown in "Exhibit B." Further,
that Condition 4 be modified to reflect construction hours of Monday through Friday, 8:00 a.m. to
5:00 p.m.

ROLLCALLVOTE

AYES:
NOES:
ABSENT:
ABSTAIN:

Commissioners Kameny, Roberts, Sullivan, and Chairperson Kumaran
None
Commissioner Maas
None

Resolution No. PC-99-53 was entered and adopted as motioned.

PLANNiNG COMMISSION MiNUTES Page 4 August 11, 1999
