Mr. Swift noted that the City Council approved the PUD for this application at the May 18, 1999 City <br />Council meeting. Further, Mr. Swift referenced a staff report dated June 23, 1999 and highlighted key <br />areas contained in the report including background information and project description. In conclusion, <br />Mr. Swift stated that staffs recommendation is that the Commission make the tentative map findings as <br />listed in the staff report and approve the tentative map application subject to the conditions listed in <br />Exhibit "B." <br /> <br />Discussion ensued relating to whether the developer is the City or whomever develops the individual <br />lots, and materials used for fencing. <br /> <br />The representative of Passport Homes noted that the conditions will be part of the design guidelines as <br />one of the conditions of approval. He stated that it would be beneficial to direct staff to do some <br />housekeeping in regards to conditions, and he noted that the applicant is in full agreement with staffs <br />recommendations. He concluded by expressing appreciation to staff for their support with the project <br />and help in plaxming the project, and requested that the Commission vote in favor of approving <br />application. <br /> <br />Discussion ensued relating to the visibility of the homes in development and the applicant stated that <br />there is a brief view of the project from 1-580; however, the project is well concealed. Further, that due <br />to the steep terrain on the Panganiban Driveway, it would be beneficial to utilize Crosby Drive for <br />access to development. <br /> <br />PUBIC HEARING WAS OPENED <br /> <br />Susan Powers, 9624 Crosby Drive, noted she has no objection to the development; however, she <br />requested access to development be restricted to Crosby Drive, there be no construction on Saturdays, <br />and that dust control mitigation be utilized. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner Kameny noted his support with the tentative map as presented. He stated that he visited <br />the site several times and that the development is only visible for a few seconds while traveling on <br />1-580. Further, that the large trees being utilized and the height of the units will maximize the view <br />shed. He requested that construction activity be limited to 8:00 a.m. to 5:00 p.m., Monday through <br />Friday and that there be dust control mitigation. <br /> <br />Commissioner Sullivan noted that to approve this application the tentative map findings need to be <br />consistent with the General Plan, as listed in the guidelines. Further, that the guidelines indicate the <br />there be 670 foot elevation cap on development on Foothill Road, as noted in Measure F passed by the <br />residents in 1993. He noted that a portion of the development is higher than the 670 foot maximum <br />height which is not consistent with the findings. He noted that he would not be able to make the <br />tentative map findings and would not be in support of approving the application. <br /> <br />Mr. Swirl noted that a majority of the elevation of the development is within the parameters of the <br />Measure F initiative which is consistent with the General Plan.
