ROLL CALLVOTE <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Commissioners Cooper, Kameny and Vice-Chairperson Roberts <br />None <br />Commissioner Maas, Sullivan and Chairperson Kumaran <br />None <br /> <br />Resolution No. PC-99~36 was entered and adopted as motioned. <br /> <br />UP-99-8, Outdoor World <br />Application for a conditional use permit to allow firearm sales in an existing retail store <br />located at 3903 Santa Rita Road. Zoning for the property is PUD (Planned Unit <br />Development) - C (Commercial) District. <br /> <br />Mr. Iserson referenced a staffreport dated May 26, 1999, and highlighted key areas contained in the <br />report including background information, site description, project description, land use analysis, security <br />and safety issues, and city, state, and federal codes. Mr. Iserson noted that staff has recommended an <br />additional condition for ammunition to be locked in a display case, such as WalMart had agreed to do. <br />In conclusion, Mr. Iserson noted that staff's recommendation is that the Planning Commission make the <br />required use permit findings for approval and adopt a resolution which would approve Case UP-99-08 <br />subject to the conditions in Exhibit "B" plus staffs memorandum dated May 26, 1999. <br /> <br />Discussion ensued relating to whether WalMart sells handguns, Condition No. 10 of separately locking <br />handguns versus the chain mechanism currently used, the purpose of the condition requiring that buyers <br />of guns be walked to their cars, differences between a neighborhood shopping center versus a regional <br />shopping center, conditions for this application being the same as the WalMart application, and <br />procedures used when purchasing guns. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Bob Thomas, applicant, noted his pleasure with the store reopening in Pleasanton and that Outdoor <br />World is a full line sporting goods store. He noted his concurrence with staff's recommendation with <br />displaying firearms with trigger locks and that free trigger locks are given away with the purchase of <br />guns. He stated that to ensure the safety of employees and customers, a driver's license is requested <br />from persons desiring to inspect and handle a firearm and that Outdoor World is concerned with the <br />safety of neighbors adjacent to stores. Mr. Thomas sought clarification relating to Condition No. 16, <br />and noted he is unclear on the legal responsibility of staff and the store of accompanying firearm <br />purchasers to their cars. Mr. Iserson noted this condition is to ensure that people who purchase guns are <br />not walking around the store with a firearm in their possession. Mr. Thomas further requested that the <br />store be allowed to remove trigger locks on firearms to allow customers to handle guns and ensure a fit <br />of the gun to customer; however, he stated that dry-firing of guns is discouraged. Mr. Thomas <br />commented on the requirements necessary to purchase firearms, including record of sales information <br />form sent to the Department of Justice in Sacramento and an immediate ATF check.
