Commissioner Kameny suggested that the applicant be required to contribute a cash contribution for
public art at a different location in the City ifa suitable location on the project cannot be found.

In response to an inquiry by Commissioner Cooper as to whether a cash contribution for art is a viable
option, Mr. Iserson noted that the preference would be for the applicant to work with the Civic Arts
Commission to identify a smaller piece of art that can be erected on property; however, he noted that a
cash contribution to public art could be requested as an alternative.

Commissioner Cooper concurred with Commissioner Sullivan's statements relating to traffic impacts;
however, he noted that not all of the traffic issues radiate from Hacienda Business Park. He further
noted that this kind of project will bring revenue to the City, but will have an impact on traffic. He
noted he would vote in support of approving application.

Commissioner Kameny suggested that a condition of approval be included that the applicant work with
the Civic Arts Commission to identify a suitable location for public art on project site or an acceptable
alternative. Commissioner Cooper expressed concurrence with that being a condition of approval.

A motion was made by Commissioner Kameny, seconded by Commissioner Cooper, to adopt a
resolution approving PUD-81-30-78D subject to Exhibit "B," Draft Conditions of Approval, with
a modification to Condition No. 9 allowing "an acceptable alternative" to provide public art if
there is insufficient space on the site.

ROLL CALLVOTE

AYES:
NOES:
ABSENT:
ABSTAiN:

Commissioners Cooper and Kameny
Commissioner Sullivan
Chairperson Kumaran and Commissioners Maas and Roberts
None

The motion carried on a 2 - 1 vote.

Resolution No. PC-99-31 was entered and adopted as motioned.

(Recess taken from 8:25 p.m. to 8:29 p.m.)

PUD~81-30-79D~ Prudential Insurance Company of America
Application for Planned Unit Development design review approval to allow five new office
buildings as follows: one approximately 70-foot high, 97,000-square foot, four-story
building; two approximately 70-foot high, 120,000-square foot, four story office buildings;
and two approximately 43-foot high, 30,000-square foot, two-story office buildings located
at 5860 and 5890 Owens Drive and 4701 Chabot Drive.
