A motion was made by Commissioner Kameny, seconded by Commissioner Sullivan, approving <br />the design review and conditional use permit applications, Z-98-342 and UP-99-04 subject to the <br />conditions shown in Exhibit "B" and "C" and staffs memo dated April 14, 1999. <br /> <br />ROLL CALL VOTE <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Commissioners Cooper, Kameny and Sullivan <br />None <br />Chairperson Kumaran and Commissioners Maas and Roberts <br />None <br /> <br />Resolution No. PC-99-27 was entered and adopted approving Case Z-98-342/UP-99-04 as motioned. <br /> <br />PUD-98-18, Robert S. Enea <br />Application for Planned Unit Development rezoning to PUD - O (Planned Unit <br />Development ~ Office) and development plan approval for the construction of an <br />approximately 3,220 square-foot, two-story office building located at 3925 Old Santa Rita <br />Road. Zoning for the property is C-S (Service Commercial) District. <br /> <br />Mr. Iserson referenced the staff report dated April 14, 1999, and highlighted key areas contained in the <br />report including background information, project description, building design, site development <br />standards, parking, grading and drainage plan, landscape design, replacement of sidewalk along Old <br />Santa Rita Road, traffic, signage, and public notice. In conclusion, he stated that staff's recommendation <br />is that the Commission find that the project would not have a significant effect on the enviromnent and <br />adopt a resolution approving the attached draft Negative Declaration; find that the project has a de <br />minimis impact on the site's wildlife; make the PUD findings as listed in the staff report; and, <br />recommend approval of the PUD re×oning and development plan subject to the conditions listed in <br />Exhibit "B." <br /> <br />Discussion ensued relating to parking spaces, possible ways to separate driveway from landscaped areas, <br />and whether an analysis has been performed of possible future flooding of the creek. Mr. Higdon <br />responded that staff has looked into the issue and has concluded that flooding will not be a problem <br />since the creek has been designed appropriately. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Tom Kubo, representing the Applicant, expressed appreciation to staff for their work on project. He <br />noted the mitigation measures taken by the applicant and stated that the applicant is in concurrence with <br />the conditions listed in Exhibit "B."
