Declaration; find that the project has a de minimis impact on the site's wildlife; and, recommend <br />approval of Case RZ-98-10 to the City Council. <br /> <br />Discussion ensued relating to the Downtown Specific Plan ordinance not being in effect, R-6500 being <br />the zoning of adjacent properties, and review of project design being brought back before the <br />Commission if staff denies it. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Dale Morris, 141 Ray Street, informed the Commission that the design of the home is still being worked <br />on and that due to the lot being narrow and deep, rezoning is necessary to build another structure. <br /> <br />Linda Adams, 159 Ray Street, requested that the Commission approve the application and staff approve <br />the design of house. <br /> <br />Glenn Higgins, 159 Ray Street, expressed concern with rezoning being necessary in order to <br />accommodate a new house on the lot. He noted that a variance would have been a viable altemative. In <br />conclusion, he spoke in support of the Commission approving project. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner Cooper expressed support with rezoning and stated that if staff approves the design of the <br />project, the design of the project would not have to be brought before the Commission. <br /> <br />Commissioner Maas stated she has no comment. Commissioner Kameny stated he would be in support <br />of the project if it conforms to the General Plan with the same zoning and setbacks. Commissioner <br />Roberts, Commissioner Sullivan, and Chairperson Kumaran expressed concurrence with Commissioner <br />Kameny's statements. <br /> <br />A motion was made by Commissioner Cooper, seconded by Commissioner Maas, that the project <br />would not have a significant effect on the environment and that a resolution be adopted <br />recommending the approval of the attached draft Negative Declaration; and findings that the <br />project has a de minimis impact on the site's wildlife. <br /> <br />ROLLCALLVOTE <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Commissioners Cooper, Maas, Roberts, Sullivan and Chairperson Kumaran <br />None <br />None <br />None <br /> <br />Resolution No. PC-99-10 was entered and adopted as motioned. <br /> <br />A motion was made by Commissioner Roberts, seconded by Commissioner Maas, recommending <br />approval of Case RZ-98-10 to the City Council. <br /> <br />PLANNING COMMISSION MINUTES Page 7 February 10, 1999 <br /> <br /> <br />
