ROLL CALL VOTE <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Commissioners Cooper, Maas, Roberts, Sullivan and Chairperson Kumaran <br />None <br />None <br />None <br /> <br />Resolution No. PC-99-11 was entered and adopted as motioned. <br /> <br />U-98-37/Z-98-176, Peter Shutts/Russ Morgan <br />Application for design review and conditional use permit approvals to allow a rental yard, <br />outdoor storage, and accessory uses; to allow the placement of modular buildings, shipping <br />containers, and a new maintenance building on site; to allow the construction of a new <br />business sign; and to allow the repainting of an existing building located at 3878 Stanley <br />Boulevard. Zoning for the property is C-S (Service Commercial) District. <br /> <br />Commissioner Maas noted that she has a conflict of interest relating to U-98-37/Z-98-176, Peter <br />Shutts/Russ Morgan, and will be abstaining from discussion and voting. <br /> <br />Mr. Iserson referenced a staff report dated February 10, 1999 and highlighted key areas contained in the <br />report including background information, current proposal, Municipal Code violations at 3878 Stanley <br />Boulevard, land use compatibility and design, noise and public comment. In conclusion, he stated that <br />staffs recommendation is that the Planning Commission deny Case UP-98-37/Z-98-176. <br /> <br />Discussion ensued relating to areas of compatible land use in Pleasanton for this type of business and <br />whether outdoor tents have been removed. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />William Hays Weissman, 7901 Stoneridge Drive, Suite 401, noted that his client, the applicant, has <br />exhibited frustration with past use compliance issues due to his inability to remove anything from site <br />without permits. He noted only one anonymous complaint has been noted in relation to noise and noted <br />it was unclear whether the complaints by other adjacent residents related to noise. He stated that there is <br />not an abundance of noise coming from project and noted there is noise coming from other businesses <br />along Stanley Boulevard. He noted that this project should not be denied due to future land-use <br />compatibility of adjoining lots when usage for lots has not been determined. He noted that adjacent <br />properties are zoned for commercial use and should remain that way. <br /> <br />Discussion ensued between the Commission and staff relating to the recommendations of staff not met <br />by the applicant. Mr. Iserson stated that staff has never told the applicant that he could not remove <br />anything from the site.
