has requested that power lines be undergrounded and that the applicant has agreed. He further
expressed concern with the encroachment of the gazebo towards his property and with future
neighbors objecting to future development on the Wiemken property. He noted that as a
condition of approval he is requesting that the applicant agree that when future development
occurs on the vacant lot east of the applicant's home, the subject of blocking views and impact
on privacy will not be issues for the applicant or their successors.

PUBLIC HEARING WAS CLOSED.

Chairperson Roberts expressed concern with the possible subdivision of the lot. She noted that
the house fits with the FAR and is well-designed; however, the house and the tennis courts cover
a large portion of the lot. Commissioner Maas noted this a good location for a house this size.
Chairperson Roberts noted she has concerns with subdividing this property at a later time.

Discussion ensued relating to the future subdivision of the property not being part of this
application.

Chairperson Roberts noted that the addition was well done. She expressed support for no trees
being removed and the consideration given to the historical value of the home.

Commissioner Sullivan noted this is a large home; however, it does not seem out of place in this
setting and does not have an impact on the community as a whole. He expressed concern with
what will be built on the adjacent lot and with the subdivision of the property. He noted that
since the subdivision is not a part of this application, he would vote in support of approving the
application.

Discussion ensued regarding construction hours on Saturdays.

Commissioner Axkin noted his support for approving the application.

A moties~ was made by Commissioner Maas, seconded by Chairperson Roberts, that the
Commission make the conditional use permit findings and approve Case UP-99-06/Z-99-$8,
s~bject to the conditions listed in Exhibit "B, ' that construction hours be limited to
Monday through Friday unless the neighbors contact staff and request that construction
hours b~ allowed on Saturdays, and that power lines be undergrounded.

ROLL CALL VOTE

AYES:
NOES:
ABSENT:
ABSTAIN:

Commissioners Arkin, Maas, Sullivan, and Chairperson Roberts
None
Commissioner Kameny
None

Resolution No. PC-2000-17 was entered and adopted as motioned.

PLANNING COMMISSION MINUTES February 23, 2000 Page 10
