<br />r <br /> <br />A motion was made by Commissioner Arkin, seconded by Commissioner Kameny, to <br />approve tile proposed modification to tile "Fint Amendment to Development Agreement." <br /> <br />ROLL CALL VOTE: <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Commissioners Arkin, Karneny, Maas, and Chairperson Roberts <br />None <br />None <br />Commissioner Sullivan <br /> <br />The motion passed on a four to zero vote. <br /> <br />Resolution No. PC-20OO-11 was entered and adopted as motioned. <br /> <br />d. Z-99-290. Bob 8Dd ROBi Penta <br />Application for a design review approval to construct a two-story, 4,419-square-foot <br />custom home on a vacant lot located at 8093 Bethel Lane. Zoning for the property is <br />PUD-LDR (planned Unit Development - Low Density Residential) District. <br /> <br />r <br /> <br />Mr. Plucker referenced a staff report dated February 9, 2000 and highlighted key areas contained <br />in the report including background infonnation, project site and description, geotechnical study, <br />tree study, visual analysis, and landscape plan. In conclusion, he stated that staff's <br />recommendation is that the Commission approve Case Z-99-290, subject to the conditions listed <br />in Exhibit "B." <br /> <br />Discussion ensued relating to the location of the buildable part of the lot, the proximity of the <br />building to the backdrop, the location of oak trees, clarification of the term "pier and grade <br />foundation," and the meeting between the applicants and the neighbors. <br /> <br />PUBLIC HEARING WAS OPENED. <br /> <br />Bob Perata, applicant, noted that all issues were resolved with the neighbors and that a <br />landscaping plan was developed to satisfy all parties. He commended the planner for her work <br />on the project and provided the Commission with a sample of the colors for the project. <br /> <br />Discussion ensued relating to the hammerhead turnaround. <br /> <br />Bob Sarrasin, 3860 Blackhawk Drive, Danville, noted that the buildable lot area had been <br />previously approved and that the buildable lot area is the entire upper pad area extending to the <br />front property lines and does not extend all the way down the hillside. In response to an inquiry <br />by Chairperson Roberts, Mr. Sarrasin noted the only condition the applicant does not agree with <br />is Condition No. 17. He noted that the applicant might be agreeable to the condition if they <br />could view other buildings that utilize the suggested colors. He noted that the applicants are <br />concerned that Condition No. 17 will cause the house to resemble a battleship.
