Commissioner Maas noted that from the beginning of this project, she has felt the house was too
{'. large for the lot. She noted that Mr. Chestnut has gone through the appropriate steps with the
City and that the zoning administrator has approved the plan. She noted she would be in favor of
upholding the Zoning Administrators decision and that she would not be in favor of removing
the roof.

Commissioner Maas moved that the Commission deny Case P AP-03 thereby upholding the
Zoning Administrator's approval of Case Z-98-310 (house addition) and Z-98-311 (second unit
height modification); that building inspections be conducted on a regular basis to ensure that
other errors in the project do not occur; that fmes be instituted for any additional errors; that a
development calendar be distributed to the neighbors for timelines for completion of projects;
that building debris be disposed of properly.

Discussion ensued relating to clarification of the motion.

Chairperson Roberts requested that issues relating to the balcony be discussed. Mr. Swift noted
that the balcony has not been an issue for the neighbors. Commissioner Maas noted she would
not include the balcony issue in her motion. Chairperson Roberts requested that debris be
disposed of properly and that the height of the house be monitored.

Commissioner Arkin requested that there be an amendment to the motion that final construction
of the primary house cannot start until there is final completion of the bam and bungalow.
Commissioner Maas noted it was not fair for the Commission to impose that kind of time
r schedule. Discussion ensued relating to clarification of the amendment.

Mr. Plucker noted that Mr. Chestnut, his contractor, and staff will be meeting to discuss siding
for the bam to replicate the existing structure.

Commissioner Sullivan noted he originally did not support the design of the house and that the
house is completely out of place in the neighborhood. He noted that the house is being forced on
the neighbors. He stated that the Planning Commission and the City Council were in support of
Mr. Chestnut working with the neighbors to develop a plan, and he still supports that idea. He
noted that after hearing tonight's testimony, he is not convinced that the neighbors agreed with
the plan. He stated that the goal of the Planning Commission and the City Council for
Mr. Chestnut to reach an agreement with the neighbors never happened, and, therefore, he would
not be in support of the motion. He noted that upholding the appeal is not necessarily
constructive in getting the project done; however, supporting the motion does not resolve the
issues.

Commissioner Maas moved to modify the Zoning Administrator's approval of Case Z-98-310
(house addition) and Z-98-311 (second unit height modification) with building inspections to be
conducted on a more regular basis than normal; that a phasing calendar be distributed to the
neighbors and the City and adhered to; and that building debris be disposed of properly.

r

Commissioner Arkin offered an amendment to the motion that final construction of the primary
house cannot start until there is final completion of the bam and bungalow.

PLANNING COMMISSION MINUTES

January 26, 2000

Page 13
