<br />f" <br /> <br />,,-.. <br /> <br />r <br /> <br />In response to an inquiry by Commissioner Maas relating to whether the architect will pay for <br />the error in height, Mr. Chestnut stated he does not think so, due to this being an honest mistake, <br />He stated that with any other project the difference in one foot would not be a problem and that <br />repairing the mistake would compromise the building, <br /> <br />Jack Chestnut, Jr., 4128 Stanley Boulevard, noted he was present on December 6, 1999 during <br />the conversation with Mr. Ciesielski and that Mr. Ciesielski requested changes to landscaping <br />but did not have any other problems with the project. <br /> <br />Patrick Knapp, 4120 Stanley Boulevard, noted that this appeal is not about liking or disliking the <br />neighbors and but only concerns the agreement that was made, He commented on the <br />compromises made between Mr, Chestnut and the neighbors. He noted that the neighbors agreed <br />to two conditions relating to setbacks for the cottage due to Mr. Chestnut's statements that he <br />had to spend an extensive amount of money on the project. He noted that it is his belief that the <br />mistake in the roof line not only came from the architect but also from tearing off the roof and <br />putting on a new roof at a different angle. He requested that the integrity of the agreements be <br />kept. He stated the intent is not to delay the project or increase the cost of the project for <br />Mr. Chestnut. <br /> <br />PUBLIC BEARING WAS CLOSED. <br /> <br />Chairperson Roberts noted her disbelief with this item continuing on for a year and disclosed she <br />bas met with Mr. Ciesielski and Mr. Chestnut and visited the Rodondi's home. She stated that <br />this neighborhood contains small, older homes with well.kept yards with the residents having <br />been in the homes for a long time. She expressed concern with the balcony providing views of <br />three of the neighbors' backyards. She further expressed concern with the length of time taken <br />to restore the barn. She noted that it might be necessary to add a condition which would require <br />gathering all construction debris on a regular basis and with debris being placed in a container <br />that is emptied on a weekly basis. She noted that no construction in the City of Pleasant on is <br />allowed to flow into someone else's yard. Chairperson Roberts noted that the second unit is <br />taller than it should be and it is a mistake; however, she would not be in favor of the roof being <br />tom off. She noted she liked the design of the second unit and the house and would be in favor <br />of heavy restrictions being placed on how the project proceeds. She stated that she was in favor <br />of the upstairs balcony being removed due to it being an invasion of privacy for the neighbors <br />and that there be additional discussion relating to the second story. <br /> <br />Commissioner Arkin noted he visited the site, and he commented on the water damage to the <br />bungalow. He expressed concern with two projects being started on the property at one time and <br />stated he would be in favor of one structure being completed before another structure is started <br />and the construction site being tidy with no debris in neighbors' yards. He noted that he does not <br />agree that the quality of life of the neighbors will be impacted by the structure being 15 feet high; <br />however, the neighbors do have a right to have the project completed within a reasonable amount <br />of time and that there should be proper disposal of debris. <br /> <br />PLANNING COMMISSION MINUTES <br /> <br />January 26, 2000 <br /> <br />Page 12 <br />
