19. <br /> <br />The developer shall enter into an agreement with the City, approved by the City <br />Attorney, which guarantees that all landscaping and open space areas included in <br />this project will be maintained at all times in a manner consistent with the <br />approved landscape plan for this development. Said agreement shall mn with the <br />land for the duration of the existence of the structures located on the subject <br />property. <br /> <br />20. <br /> <br />The developer shall provide a bond to the City guaranteeing the installation of all <br />common open space, street trees, all wet zone landscaping and visual buffer trees, <br />and all common infrastructure improvements shown on the approved development <br />plan or otherwise required as part of this development. The developer shall <br />provide an itemized cost estimate of said improvements, to be submitted with the <br />bond, for the review and approval the Planning Director prior to issuance of <br />building permits. The bond shall be returned to the developer upon acceptance of <br />said improvements by the Planning Director. <br /> <br />21. <br /> <br />The developer shall comply with the recommendations of the tree report prepared <br />by HortScience dated May 1998, incorporated herein by reference. No tree <br />trimming or pruning other than that specified in the tree report shall occur. The <br />developer shall arrange for the horticultural consultant to conduct a field <br />inspection prior to issuance of grading permits to ensure that all recommendations <br />have been properly implemented. The consultant shall certify in writing that such <br />recommendations have been followed. <br /> <br />22. <br /> <br />The developer shall comply with the recommendations of the vegetation and <br />wildlife survey prepared by Dr. Samuel McGinnis and dated April 29, 1998 and <br />September 21, 1992, incorporated herein by reference. These mitigations also <br />shall be included in the Oak Hill Estates design guidelines. <br /> <br />Geotechnical <br /> <br />23. <br /> <br />The developer shall comply with the recommendations of the geotechnical reports <br />prepared by Engeo dated January 12, 1998 and December 8, 1998 and with all <br />recommendations made by the City' s peer reviewing geologist, all incorporated <br />herein by reference. The developer's geotechnical consultant shall review and <br />approve all foundation, retaining wall, drainage, and geotechnical aspects of the <br />final development plans to ensure that the recommendations have been properly <br />incorporated into the development. The consultant shall certify by writing on the <br />plans or as otherwise acceptable to the Director of Building Inspection that the <br /> <br /> <br />
