Resolution No. PC-99-07 <br />Page 4 <br /> <br />If the project is developed in phases, prior to each subsequent phase after the first <br />phase is completed, the applicants shall prepare a traffic study, satisfactory to the <br />City Engineer, using the City's standard assumptions for a short-term traffic study <br />and coveting the Mozart PUD affected intersections. In the event that "existing <br />plus approved plus project" traffic conditions would create a LOS E condition, the <br />applicants shall utilize mitigation measures to lower the service level to LOS D <br />(v/c ratio of 0.90 or lower) or building permits shall be withheld for that project <br />phase. Should the only available mitigations be not feasible for the applicants to <br />implement on its own, the applicants shall assume a leadership role in requesting <br />the formation of an appropriate assessment district or other mechanism to provide <br />the required mitigation improvements. The City shall cooperate in the formation <br />of such districts or other mechanisms so that benefited properties would pay their <br />fair share of the improvements. In the event that the entire project is built in one <br />phase, the City shall determine which, if any, of the required traffic mitigations to <br />the Stoneridge Drive/Stoneridge Mall Road intersection and the Foothill <br />Road/Dublin Canyon Road/Canyon Way intersection shall be constructed by the <br />applicant. <br /> <br />The applicants shall implement the commute programs and physical infrastructure <br />improvements as outlined in the Transportation Demand Management Plan dated <br />January 1999. The physical infrastructure improvements (i.e., bicycle racks, <br />preferential parking for vanpools and carpools, and showers in buildings) shall be <br />installed with construction of each building. Said improvements shall be shown on <br />the building permit plans and shall be subject to review and approval by the City <br />Engineer and Planning Director prior to issuance of building permits for the <br />project. <br /> <br />10. <br /> <br />If the project is subdivided in the future, cross parking agreements and reciprocal <br />access, maintenance, and utility easements shall be recorded over each parcel. <br />Prior to recordation, the applicants shall submit the wording for the parking <br />agreements and easements to the City Attomey for review and approval. <br /> <br />11. <br /> <br />If the project is developed in phases, each phase of the project shall contain on-site <br />parking at a minimum ratio of one space for each 300 sq. fi. of gross floor area. <br /> <br />12. <br /> <br />If the project development is phased, undeveloped phases shall be hydroseeded <br />and kept in a neat and weed-free manner at all times. Weed control shall be <br />provided by mowing or by discing if acceptable dust and erosion control measures <br />are implemented by the applicants. <br /> <br /> <br />
