18.106.020 Conditional use permit requirements. <br /> <br /> A conditional use permit shall be required for any second unit. All of the <br />requirements of Chapter 18.124 shall apply hereto, except that the Zoning Administrator <br />shall hold the public hearing and make the required findings, as provided in § 18.124.060 <br />and § 18.124.070 of the Municipal Code, unless the Zoning Administrator determines in <br />his or her sole discretion to refer the matter to the Planning Commission. Decisions of <br />the Zoning Administrator may be appealed to the Planning Commission, and decisions of <br />the Planning Commission may be appealed to the City Council as provided in <br />§18.124.090 of the Municipal Code. All second units shall be publicly noticed as <br />described in §18.124.040. <br /> <br />18.106.030 Attached second units--Height limitations, setbacks, open space, and <br /> other regulations. <br /> <br />mo <br /> <br />Attached second units shall be subject to the maximum height, and the <br />minimum front, rear, and side yard requirements of the main structure. <br /> <br />Attached second units in a multi-family residential zoning district shall <br />meet the open space requirement as required for apartments with the same <br />number of bedrooms in the applicable zoning district(s). <br /> <br />Except as modified by this Chapter, all other regulations embodied in the <br />zoning of the property for main dwellings shall apply to the development of <br />attached second units. <br /> <br />18.106.040 Detached second units in one-family residential districts--Permitted <br /> districts, height limitations, and other regulations. <br /> <br />Detached second units in a one-family residential district shall only be <br />permitted on lots zoned or subject to the development standards of the <br />R- 1-40,000, R- 1-20,000, or R- 1-10,000 zoning districts. <br /> <br />Bo <br /> <br />Detached second units in a one-family residential district shall not exceed <br />fifteen feet (15') in height and shall be limited to one (1) story structures. <br /> <br />Exhibit A.2/RZ-98-03 <br /> Page 2 <br /> <br /> <br />
