(2) distributes or attempts to distribute any written <br />or printed matter which advises, counsels or urges <br />insubordination, disloyalty, mutiny or refusal of duty <br />by any member of the military or naval forces of the <br />United States--shall be fined not more than $10,000 or <br />imprisoned not more than ten years, or both, and shall <br />be ineligible for employment by the United States or <br />any department or agency thereof, for the five years <br />next following his conviction. <br /> <br /> WHEREAS, such conduct on the part of students and <br />faculty has given aid and comfort to the enemies of the United <br />States contrary to the Constitution of the United States; and <br /> <br /> WHEREAS, the District Attorney, Sheriff, and all other <br />law enforcement officers in Alameda County have warned that <br />there is extreme danger of riots and disorders if additional <br />Viet Nam Day Committee marches are held; and <br /> <br /> WHEREAS, the University of California, a tax supported <br />institution, has permitted its facilities to be used for the <br />aforementioned purposes and has aided and abetted such activi- <br />ties by <br /> <br />Allowing the use of classrooms for instruction <br />and indoctrination sessions by the Free Speech <br />Movement and Viet Nam Day Committee. <br /> <br />Permitted and allowed classes in Leninism and <br />Marxism to be held at Dwinelle Hall taught by <br />revolutionaries. <br /> <br />me <br /> <br />Allowed the use of the University of California <br />campus for a staging area for the aforementioned <br />march. <br /> <br /> 4. Using public funds to construct a platform and <br /> ramps for the use of the Vier Nam Day Co,,aittee. <br /> <br /> 5. Furnished the Vier Nam Day Committee with loud- <br /> speakers and sound amplifying equipment; and <br /> <br /> ~&LEREAS, during each of the aforementioned demonstra- <br />tions, the law enforcement~agencies of Alameda County were <br />required to divert officers from their regularly assigned <br />duties leaving large areas of Alameda County without adequate <br />police protection; and <br /> <br /> WHEREAS, the aforementioned activities of the so-called <br />Free Speech Movement and Vier Nam Day Con~nittee hay ~ost the <br />tax payers of Alameda County in excess of $106,000 ~o additional <br />Police, District Attorney, Court and Probation services; and <br /> <br /> WHEREAS, if a riot insues as a result of the activities <br />of the so-called Vier Nam Day Committee there will be large <br />scale injuries and damage to persons and property; <br /> <br />- 2- <br /> <br /> <br />
