70) <br /> <br />construction of noise attenuation barriers as shown in Figure 6-1 of the Specific <br />Plan shall use building construction techniques to reduce noise to the extent <br />feasible, where outdoor use is a major consideration (eg. backyards in single- <br />family residential areas and recreational areas in multi-family residential areas), <br />consistent with other Specific Plan goals. <br /> <br />b) <br /> <br />Residences that abut the open space and that are affected by a roadway sound <br />source may be subject to ambient noise levels following construction of noise <br />attenuation barriers without further exterior noise mitigation as described above <br />being required. <br /> <br />c) <br /> <br />For residential uses in areas where the noise source fi.om a railroad (e.g. along the <br />UPRR tracks) exceeds a maximum train pass-by level of 75 dBA, interior noise <br />shall be limited to a maximum instantaneous noise level of 50 dBA in bedrooms <br />and 55 dBA in other rooms through a combination of soundwall and building <br />construction techniques. <br /> <br />Noise-Sensitive Park Uses. For park uses where the ambient noise levels exceed <br />65 dBA Leq (daytime noise), locate noise-sensitive park uses in areas where the ambient <br />noise level is projected to be less than 65 dBA. <br /> <br />N. WETLANDS AND BIOLOGICAL RESOURCES <br /> <br />71) <br /> <br />Wetlands Assessment. If needed, Property Owner shall prepare a pm-jurisdictional <br />wetlands assessment satisfactory for U.S. Army Corps of Engineer's permit review prior <br />to any development activity (including grading) on the Project site. Property Owner shall <br />obtain verification from the Army Corps of Engineers (Corps) of the Corps' jurisdiction <br />of wetlands and other federally regulated waters of the U.S. on the Project site prior to <br />application to City for any grading permit. <br /> <br />72) <br /> <br />Permit Required. If needed, Property Owner shall obtain necessary approval of a Clean <br />Water Act Section 404 permit fi.om the Corps and/or any other governmental agency with <br />Section 404 authority prior to application for a grading permit fi.om City to fill <br />jurisdictional wetlands and 9ther federally regulated waters of the U.S. A letter from the <br />Corps, or copy of the permit, shall be submitted to the Planning Director indicating that <br />necessary permits for altering or filling wetlands or other federally regulated waters have <br />been obtained, or that such permits are not required. Any additional conditions related to <br />grading imposed by the Section 404 permit shall become conditions of applicable grading <br />permits. <br /> <br />73) <br /> <br />Wetlands Mitigation Plan. Property Owner shall retain a qualified wetland consultant <br />to prepare a detailed Wetlands Mitigation and Monitoring Plan, including identification <br />of avoidance alternatives, if Corps requires mitigation for those areas to be filled. Such <br />Mitigation Plan shall be submitted for review and approval by the Corps and the Planning <br />Director, and shall be consistent with the Corps' Habitat Mitigation and Monitoring <br /> <br />Conditions of Approval Page 39 of 44 August 9, 2000 <br /> <br /> <br />
