58) <br /> <br />59) <br /> <br />60) <br /> <br />to Bay" using City-approved method~ and materials. <br /> <br />Property Owner shall offer for dedication to the City of Pleasanton all property <br />owned by Property Owner located between the easterly top of bank to the <br />westerly top of bank of the Arroyo de ia Laguna. An irrevocable offer of <br />dedication shall be made a condition of approval of the MVTM. Until accepted <br />by the City, this area shall be maintained by a maintenance association of the <br />owners of lots within the Western Area. Fencing of the Arroyo will be permitted <br />with an open wire fence, the design to be approved by the Planning Director prior <br />to its installation. <br /> <br />Payment of Zone 7 Drainage Fees. Property Owner shall pay any applicable Zone 7 <br />Storm Drainage Fees. Such fees shall be paid at time of approval of any Final Map, or as <br />required by Zone 7 ordinance. Property Owner may obtain fee credits or compensation <br />for any land dedications or other improvements, consistent with Zone 7's SDA 7-1 <br />Assessment District reimbursement program. <br /> <br />Additional Flooding Protection. If regional flood control improvements are not <br />finalized for the Arroyo de la Laguna by Zone 7 and/or other responsible agencies prior to <br />approval of the first grading permit within the Western Area, Property Owner shall have <br />the option to protect on-site development in the Western Area from floods in excess of <br />the FEMA 100~year storm event by constructing berms or levees, or by raising building <br />pad elevations in this area. <br /> <br />Design for such flood control protection measures shall be reviewed and approved <br />by the Planning Director and Director of Public Works prior to approval of a <br />grading permit for such construction. <br /> <br />b) <br /> <br />Such improvements shall not cause flooding of habitable structures on the west <br />side of Arroyo de la Laguna immediately adjacent to the Property during a FEMA <br />500-year flood event, after the improvements have been made. <br /> <br />Water Quality. Property Owner shall prepare the following detailed plans for <br />implementation during grading, construction and operation of Project in order to protect <br />the quality of surface water ~d groundwater resources to the extent feasible: <br /> <br />Prior to approval of grading permits, Property Owner shall prepare, for City <br />review and approval, an erosion/sedimentation control program that conforms to <br />design guidelines of the Pleasanton Grading Ordinance and the Association of <br />Bay Area Governments Manual of Standards for Erosion and Sediment Control <br />Measures. This Program shall also meet all requirements of National Pollutant <br />Discharge Elimination System (NPDES) program with respect to construction- <br />related pollutant discharges.
