43) <br /> <br />through avoidance or capping, following preparation of a Resource Recovery Plan <br />as described in Subsection c) below. Avoidance or capping oftbe resource shall <br />ensure that either no soils are disturbed during site preparation, or that the existing <br />ground surface is covered by additional soils or paving prior to development such <br />that no disturbance to underlying resources occur. Capping activities shall be <br />monitored by a qualified archaeologist. <br /> <br />i) <br /> <br />Protection of known cultural resources in the southeast quadrant of the <br />1-680/Bemal interchange should be accomplished via "capping" of the <br />commercial parking lot, or preparing and implementing a Resources <br />Recovery Plan prior to disturbing the site. <br /> <br />ii) <br /> <br />The entry roadway from Bemal Avenue on the Westem Area should be <br />designed to avoid any interference with the cultural resource known to <br />exist in this area. <br /> <br />b) <br /> <br />Similar avoidance of any cultural resource sites that may be discovered during <br />future monitoring or survey activities should be attempted. If avoidance <br />alternatives would materially affect development of the Property as set forth in the <br />development plan such that known or newly discovered sites cannot reasonably be <br />avoided, Property Owner shall prepare a Resource Recovery Plan meeting <br />appropriate professional, City and State standards. <br /> <br />c) <br /> <br />The Resource Recovery Plan shall be designed and implemented to gather <br />sufficient quantity and diversity of data types at identified sites, and/or set aside a <br />sufficient portion of each site for potential later investigation, to consider the loss <br />less than significant. No land disturbing activities shall be permitted until the <br />Resource Recovery Plan is prepared and accepted by the City. Similarly, no land <br />disturbing activities may be undertaken on the portion of the site set aside for later <br />investigation until that investigation has taken place. <br /> <br />i) <br /> <br />Should human remains or burial site be discovered, Property Owner shall <br />consult with City and tribal representatives to determine the appropriate <br />disposition of findings. <br /> <br />ii) <br /> <br />Property Owner shall document any archaeological findings at the site in a <br />report meeting professional standards, and file the report with appropriate <br />State and City offices. <br /> <br />Monitoring. In those portions of the Project where surface indicators or previous <br />investigations suggest that cultural resources may be present, a qualified archaeologist <br />shall be present during grading and site preparation activities. If cultural resoureas are <br />uncovered, land disturbing activities will be discontinued within a 35-foot radius until the <br />discovery can be evaluated by the monitoring archaeologist and appropriate mitigations <br />can be determined. <br /> <br />Conditions of Approval Page 21 of 44 August 9, 2000 <br /> <br /> <br />
