31) <br /> <br />32) <br /> <br />i) <br /> <br />Property Owner shall design, in coor~tination with City parks staff, <br />improvements to the Parcel 3 neighborhood park containing the elements <br />shown in Exltibit 18. The park design shall be based on improvements not <br />to exceed $650,000, including design, engineering, and construction costs. <br />Final approval of the park's design shall be made by the Park and <br />Recreation Commission. <br /> <br />ii) <br /> <br />Property Owner shall begin construction of the park prior to or at the time <br />of the issuance of the 116th building permit on Pareet 2. Should the <br />construction bid, coupled with other costs, exceed $650,000, the Property <br />Owner shall be entitled to modify the park improvements, in conjunction <br />with City review and appmvai of the adju~iments, to meet the total cost <br />limit. The City and Property Owner may agree, however, to construct a <br />park costing in excess of $650,000 by crediting any excess against the <br />Property Owner's in-lieu park fee obligation. Once begun, construction <br />shall be expeditiously pursued so as to complete the park improvements <br />within a reasonable time. <br /> <br />iii) <br /> <br />Once the improvements are completed, the City shall accept the dedication <br />and improvements. Thereafter, the City shall maintain the park except that <br />Property Owner shall provide a security bond or other secondary <br />mechanism to function as a one-year warranty on all park improvements. <br /> <br />Village Commons. The Property Owner shall develop the Village Commons (Parcel 9) <br />in conjunction with the development of the apmhaent project on Parcel lO. The <br />commons shall be open to the public. <br /> <br />The design of the Village Commons shall be synchronized with the <br />commereiai/offiee plaza and shall create a rich, usable space for both residents <br />adjoining the commons and office workers. Elements should include a focal point <br />along Valley Avenue, seating, both shaded and unshaded, lawn area, a landscape <br />plaza area, and children's play area. The design should strive to create an urban, <br />pocket park feel which uses richness in the landscape/architectural palette to offset <br />its small size. Final design shall be subject to review and approval by the Park <br />and Recreation Commission. <br /> <br />b) <br /> <br />Maintenance and, as necessary, scheduling of events shall be done by the Property <br />Owner of the ap~uhnent project, Parcel 10. <br /> <br />Regional Trails. Property Owner shall provide landscaping, fencing, or other <br />appropriate buffer to minimize conflicts between users of the Transportation Corridor <br />planned trail and adjacent private uses on Parcel 19. <br /> <br />a) <br /> <br />Property Owner shall coordinate its construction of the planned EVA within the <br />Transportation Corridor with the City and East Bay Regional Park District so as <br /> <br />Conditimas of Approval <br /> <br />Page 15 of 44 <br /> <br />August 9, 2000 <br /> <br /> <br />
