17) <br /> <br />i) <br /> <br />Require notice of the presence of, and. typical activities associated with, <br />the commercial, industrial, and warehouse uses which exist easterly of the <br />Transportation Corridor to all residential units located southerly of <br />Junipero S~eet and easterly of a direct Case Avenue extension. <br /> <br />ii) <br /> <br />Require notice of the future use of regional trails, as shown in the Specific <br />Plan, to all directly adjoining residential units. <br /> <br />iii) <br /> <br />Require notice of projected noise levels for all residential units which are <br />projected to lie within areas of 65 dBA Ldn or higher ambient noise levels, <br />after the noise mitigation measures included in this PUD have been <br />implemented. <br /> <br />iv) <br /> <br />Require notice of future Phase II public uses, Fairgrounds, and railroad <br />activities, both existing and projected, to residential units that could be <br />affected by such activities, as determined by the Planning Director. <br /> <br />c) <br /> <br />Notice shall be incorporated into CC&R's or other legal documents designed to <br />give notice to all furore purchasers of affected residential units. Final review of <br />these disclosure notices shall be reviewed and approved by the City Attorney prior <br />to approval ora final map creating parcels designed to be sold to an ultimate <br />residential user within areas requiring such disclosure. <br /> <br />PUD D~velopment Plans Required. A PUD Development Plan shall be required to be <br />approved prior to development of: <br /> <br />a) Any use on Parcel 7, the commercial use designated site. <br /> <br />Any use on parcels designated Phase II - Interim Open Space (Parcels 4, 5, 8, 14, <br />15, 16, 18, and 20) and, if not used for residential use, the Optional Residential <br />sites (Parcels I and 12). <br /> <br />c) <br /> <br />Any use which seeks to significantly modify the development standards included <br />in this PUD. At the discretion of the Planning Director, such changes may be <br />processed as either major modifications requiring a review as described in (e) <br />below or as minor modifications following the process established in the PUD <br />District regulations for such modifications. <br /> <br />d) <br /> <br />A PUD Development Plan shall be submitted in accordance with the requirements <br />of Municipal Code Section 18.68.110 for PUD Development Plans generally. <br />Relevant information which has previously been provided as part of the Initial <br />Project Approvals need not be re-submitted. <br /> <br />e) <br /> <br />Review of a PUD Development Plan shall be by the City Planning Commission <br />and City Council, with approval being by ordinance. The review process may <br />include review by other City Boards and Commissions with particular expertise in <br /> <br />Conditions of Appreval Page 9 of 44 August 9, 2000 <br /> <br /> <br />
