IV. OVERRIDING CONSIDERATIONS <br /> <br />ARer balancing the unavoidable significant and other adverse effects on the <br />enviwnment and the benefits of the Project, the City Council finds that the following <br />econernic, legal, social, technological and other benefits of the Project outweigh any <br />unavoidable significant effects on the environment: <br /> <br />1) The Bernal Property will be annexed into Pleasanton and will be developed in <br /> conformity with Pleasanton's public purposes and policies, including Pleasanton's <br /> growth management program, thereby allowing Pleasanton to manage development <br /> of the Bernal Property within its urban growth boundary in a comprehensive <br /> fashion. <br /> <br />2) 320 acres of the project site will be granted to the City, without cost, and set aside <br /> in perpetuity for recreational, institutional, public, and open space uses, to be <br /> determined as Phase II of the project. The total acreage of such dedication exceeds <br /> Pleasanton's normal requirements. <br /> <br />3) 15% of the units at the Project will be affordable housing, including: 56 duet units <br /> for moderate-income families; 20 apartment units for very-low-income families; <br /> and 11 apartment units for moderate income families. <br /> <br />4) San Francisco has sold to the Pleasanton Unified School District, at an <br /> advantageous price, an expanded 11.2-acre elementary school site, and has <br /> rearranged the Project's land use plan to allow the PUSD to acquire and develop the <br /> site in the most timely and efficient manner, with the school site scheduled to open <br /> in fall 2000. <br /> <br />5) The developer will pay PUSD's school fees in an amount greater than required by <br /> state law. <br /> <br />6) The developer will incorporate "Green Building" practices into the Project. <br /> <br />7) The developer will continue and expand bicycle and pedestrian trails and allow for <br /> the extension of regional trails. <br /> <br />8) The developer will pay for and/or finance regional and local infrastructure projects <br /> of wide benefit to all of Pleasanton, including $15 million for the Bernal Avenue/I- <br /> 680 interchange, (including) up to $700,000.00 for the new Bernal Bridge, the <br /> Valley Avenue undercrossing, other road improvements as necessary to meet <br /> Pleasanton circulation and traffic polices, and extension and upgrading of city <br /> water transmission mains and storm drainage conveyance system improvements. <br /> <br />9) The developer will dedicate a 5-acre neighborhood park in the West Parcel, a 0.9- <br /> acre Village Common special use park, and an 18-acre neighborhood / special use <br /> <br />66 <br /> <br /> <br />
