Resolution No. PC-2000-42 <br />Page 2 <br /> <br />bo <br /> <br />The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties of <br />improvements in the vicinity. <br /> <br />The proposed landscape design would create a buffer between the proposed use and <br />the existing residential uses to the east. The expected traffic to be generated by the <br />proposed use would not result in any intersection dropping to an unacceptable level <br />of service, and based upon the experience of the applicant with the same size fleet of <br />vehicles in another location within the City, the proposed use will have adequate <br />parking to mezt the project's demand. <br /> <br />Co <br /> <br />The proposed conditional use will comply with each of the applicable <br />provisions of this chapter. <br /> <br />Chapter 18.124 of the Municipal Code (Conditional Uses) states that, because of <br />their unusual characteristics, conditional uses require special consideration so that <br />they my be located properly with respect to their effects on surrounding uses. <br />Reasonable conditions of approval can integrate the proposed use without <br />detrimental effects on the neighboring property or the City in general. <br /> <br />the Planning Commission made the following variance findings: <br /> <br />Because of special circumstances applicable to the property, including size <br />shape, topography, location, or surroundings, the strict application of the <br />provisions of this chapter deprives such property of provisions of the zoning <br />ordinance deprives such property of privileges enjoyed by other properties in <br />the vicinity an under identical zomg classification. <br /> <br />The unique situation for the property owners is the location of the C-F zoned <br />parcel directly across the street from an existing residential use. The subject site <br />is the only similarly zoned lot on the block with this type of location relative to a <br />residential use. Therefore, there is physical circumstance unique to this property. <br /> <br />The granting of the variance will not constitute a grant of special privilege <br />inconsistent with the limitation of other properties classified in the same <br /> <br /> <br />
