Resolution No. PC-2000-42 <br />Page 3 <br /> <br />In order for this fmding to be made there must exist a relationship between the <br />unique characteristic of the site and the variance in question. If the lot were not in <br />such a close proximity to an existing residential use, the construction of the <br />trellises to supplement the screening provided by the proposed landscaping would <br />not be necessary. Thus, there is a direct relationship between the location of the <br />lot relative to residential uses and the need for the variance. Therefore, approval <br />of the proposed variances would not constitute the granting ora privilege. <br /> <br />The granting of the variance will not be detrimental to the public health, <br />safety or welfare, or materially injurious to properties or improvements in <br />the vicinity. <br /> <br />As conditioned, the proposed trellises must be designed to meet all applicable <br />Uniform Building Codes. The trellises were proposed to address the close <br />proximity of the site to residential uses, have been attraedvely designed, and will <br />complement the proposed landscaping for the site. The location of the proposed <br />trellises would not create a traffic line of site hazard for those drivers making <br />tums at the intersection of Pimlico Drive and Brockton Drive. <br /> <br />the Harming Commission determined that the proposed project has been designed in <br />a manner which would be functional for the proposed use while still providing an <br />attractive appearance when viewed from the street or adjacent lots and that the <br />building design would complement both the existing residential and commercial <br />uses in the area. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Recommends approval of Case PCUP-11/PD-44/PV-16, the application of C.J. <br />Doherty Jr. d.b.a. Budget Car and Track Rental/Sales for: (1) a conditional use <br />permit to conduct car and truck rental and sales; (2) design review to construct an <br />approximately 700-square-foot office building and an approximately 600-square- <br />foot hand ear wash cover; and O) a variance to allow approximately 9-foot, 8-inch <br />high decorative trellises to encroach within the required front and street-side yard <br />setback located at the northwest comer of Pimlico Drive and Brockton Drive, <br />subject to the conditions shown on "Exhibit B," attached hereto and made a part of <br />this case by reference. <br /> <br />Seotion 2. This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> <br />
