Resolution No. PC-2000-29 <br />Page 5 <br /> <br />The landscaping area at the front western comer of the site shall be a minimum of <br />6' x 6' in size. In this landscaping strip, the applicant shall plant a minimum of 1 <br />tree and groundcover and/or shrubs. The location and species of the landscaping <br />are subject to the review and approval of the Planning Director. Prior to the <br />issuance of a building permit for the kitchen in the second unit, the applicant shall <br />revise the plans to address this condition of approval. <br /> <br />The group open space area at the rear of the site shall have at least one tree, at <br />least 60 square feet of ornamental landscaping, and (the remainder of the area) <br />shall be paved and/or shall have lawn. The location and species of the landscaping <br />are subject to the review and approval of the Planning Director. Prior to the <br />issuance of a building permit for the kitchen in the second unit, the applicant shall <br />revise the plans to address this condition of approval. <br /> <br />Six hundred square feet of the rear yard area shall be group open space that can be <br />used equally by the residents of both units on site. The group open space area <br />shall not include parking, drive aisle, nor vehicle turnout areas. <br /> <br />A final landscape and irrigation plan shall be submitted to and approved by <br />Planning Director as part of the building permit plan set prior to issuance of a <br />building permit for the kitchen in the second unit. Said landscape plan shall be <br />consistent with the approved landscape plan plus any conditions of approval, and <br />shall be detailed in terms of species, location, size, quantities, and spacing. <br /> <br />10. <br /> <br />All trees used in landscaping be a minimum of 15 gallons in size and all shrubs a <br />minimum of 5 gallons in size. <br /> <br />11. <br /> <br />The applicant shall provide root control barriers and four-inch perforated pipes for <br />trees in planting areas less than ten feet in width. <br /> <br />General Requirements <br /> <br />12. <br /> <br />The applicant shall obtain and pay for all the necessary City permits for the <br />construction of the second unit. <br /> <br />13. <br /> <br />Only one residential unit on the subject property may be rented. The other unit <br />shall be owner-occupied. The resident owner(s) shall be signatory to any lease for <br />thc second unit. Thc sccond unit shall be occupied by no morc than two adults, <br />although there shall be no limit on the number of children. The applicant shall <br />prepare a deed restriction to this effect and shall submit it to the City Attorney for <br />review and approval prior to recordation. The recordation shall be accomplished <br />prior to occupancy of the second unit. <br /> <br />14. <br /> <br />In no case shall the second unit be sold, subdivided, or held under differem legal <br />ownership from the primary residence. The applicant shall prepare a deed <br />restriction to this effect and shall submit it to the City Attorney for review and <br />approval prior to recordation. The recordation shall be accomplished prior to the <br />receipt of a final occupancy certificate from the Building Department. <br /> 5 <br /> <br /> <br />
