AGREEMENT <br /> <br /> THIS AGREEMENT, made and entered into this 27th day of <br />July, 1970, by and between O. C. JONES AND SONS, a partnership, <br />First Party, and the CITY OF PLEASANTON, a municipal corporation of <br />the State of California, Second Party, under and by virtue of the <br />authority granted to it by an Act of the Legislature of the State of <br />California, designated the "Municipal Improvement Act of 1913" and <br />amendments thereto, which said Municipal Improvement Act of 1913 is <br />now embodied in the Streets and Highways Code of the State of <br />California; <br /> <br /> WI TN E S S E TH: <br /> <br /> That, whereas, First Party (as will more fully appear by <br />reference to the proceedings of the City Council of the City of <br />Pleasanton, on the 13th day of July, 1970) has been awarded the <br />contract for the work and improvements to be done in Assessment <br />District 1970-1, Longview, City of Pleasanton, Alameda County, Calif- <br />ornia, and described in the Resolution of Intention for the doing of <br />said work, which Resolution of Intention was passed by the City <br />Council of the City of Pleasanton on the 8th day of June, 1970, and <br />as described in the Amended Engineer's Report and the plans and <br />specifications for said work and improvement; <br /> <br /> NOW, THEREFORE, these presents witnesseth that for and in <br />consideration of the full and complete performance of the covenants <br />herein mutually agreed to be performed, the parties hereto do <br />covenant and agree as follows: <br /> <br /> Said First Party promises and agrees to do or perform or <br />cause to be performed in a good and workmanlike manner under the <br />inspection of the officials of the City of Pleasanton, and in <br />accordance with the plans and specifications heretofore adopted by <br /> <br />-1- <br /> <br />ORIGINAL <br /> <br /> <br />
