The bufFer azea should extend 50 feet from the base of the <br />tmnk or 25 feet from the drip line of the tree in which the nest is located, whichever is <br />greater. <br />N. Public Health and Safety <br />1. Impact Pl. Introduction of residents and workers into an azea affected by existing <br />contamination (if any). <br />Mitigation Measures: <br />Measure Pla. Determine existing contamination (if any). <br />Measure Plb. Remediate hazardous conditions (if found). <br />Measure Plc. Ifhazazdous conditions cannot be remediated, refine land use plan to <br />avoid adverse effects of contamination (if any). <br />Findine: Changes or alterations have been required in, or incorporated into, the <br />Project which avoid or substantially lessen the significant environmental effect <br />identified in [he Fina] EIR to a less than significant level. <br />Facts in Support of Finding: "the impact will be avoided or reduced based on the <br />following: <br />a. As required by Specific Plan Hazrdous Materials Policy 1, Guideline 1.1, <br />the developer has prepazed a forma] work plan and submitted i[ to the Califomia <br />Department of Environmental Health for review prior to approval of a final grading <br />plan. If contamination, exceeding statutory requirements is found, soils and/or <br />groundwater remediation plans must be prepared which address any conditions found <br />in the work plan. If the work plan reveals that irremediable contamination and <br />unacceptable health risks exist, development in the affected area will be avoided. <br />b. PUD Condition _ and Specific Plan Hazrdous Materials Policy 1, <br />Guideline 1.1, mandate preparation of a formal work plan in accordance with state <br />regulations. The work plan must be submitted to Califomia Department of <br />Environmental IIealth. The developer must comply with stahrtory requirements and <br />state regulations in responding to the recommendations in the investigation report. <br />c. In a letter commenting on the work plan, the Departtten[ of Environmental <br />Health stated [hat it concurs with the stated mitigation measures for Impacts PI and <br />P2. <br />49 <br />
