This information shatl be made available to the BAAQMD staff at the time of <br />the annual on-site performance evaluation. BAAQMD staff shall provide the <br />City at least 30 days notice of the on-site evaluation. In addition, BAAQMD <br />staff may request any or all parts of this information and data at other times <br />of the year and the City shall make such information available within 30 days <br />of notification. <br /> <br />C. The BAAQMD may contact any employer subject to the TRO. <br /> <br />Upon completion of the evaluation, the APCO shall transmit a copy of the <br />evaluation report to the City. The City shall respond within 30 days, <br />addressing any questions, issues~ or concerns raised by the APCO. Within 30 <br />days of the response, the APCO shall issue the final evaluation. If the City <br />disagrees with any of the conclusions in the final evaluation, the process set <br />forth in Section 9 of this Delegation Agreement shall be followed. <br /> <br />7. Agreement on Federal, State, and County Agencies <br /> <br />Except as otherwise provided in this Agreement, the District hereby delegates <br />all of its functions relative to Rule 1 of Regulation 13 within the geographic <br />jurisdiction of the City to the City pursuant to Sections 40233 and 40717 of <br />the Health and Safety Code. It is intended that this delegation encompasses <br />the District's authority over all persons subject to the rules and regulations of <br />the District, including any state or local government agency or public district <br />or any officer or employee thereof and the United States or its agencies. <br />(California Health and Safety Code Sec. 39047, 42 USC Sec. 7418) <br /> <br />8. Agreement on ETC Training <br /> <br />The training of Employee Transportation Coordinators (ETCs) at work sites <br />within the City must be conducted by APCO-certified training organizations. <br /> <br />The City will grant waivers from the training requirement in accordance with <br />the process specified in the Delegation Plan. This process is consistent with <br />the BAAQMD waiver process. The City shall maintain records of all waivers <br />granted and upon request shall provide this information to the BAAQ/viD staff <br />at the time of the annual on-site performance evaluation or at other times of <br />the year as described in Section 6.B. of this Agreement.
