9. Resolution of Disaereements <br /> <br />Resolution of disagreements between the City and the BAAQMD shall in itially <br />be sought at a staff level, then with the APCO is not resolved at the staff level, <br />and then between the BAAQMD Board of Directors and the City Council if <br />not resolved with the APCO. <br /> <br />10. Length of Term, Termination and Withdrawal from Deleeation Aereement <br /> <br />The length of term of this Delegation Agreement is for one year and shall be <br />automatically renewed annually unless the Delegation Agreement is <br />terminated as provided in Subsection 10.B. or either party withdraws from this <br />Agreement as specified in the procedures in Subsections 10.C. and 10.D. <br /> <br />This Delegation Agreement is terminated effective 30 days after written <br />notification to the City that the APCO has determined that: <br /> <br />Regulation 13, Rule 1 is amended and the TRO is not amended as <br />outlined in Section 2 of this Delegation Agreement; <br /> <br />2. The TRO is amended to be less stringent than Regulation 13, Rule <br /> <br />3. The TRO is rescinded by the City Council; or <br /> <br />4, The City has failed to implement and enforce the TRO or the <br /> Delegation Plan. <br /> <br />Within 30 days after the effective date of termination the City must notif'/all <br />employers subject to the TRO of the termination of the Delegation Agreement <br />and provide the APCO with the list of employers and work sites subject to the <br />rule, including names, addresses, phone numbers, recent VER or AVR <br />calculations, and any trip reduction plan(s) received by the City. <br /> <br />C. City may withdraw from this Agreement under the following procedure: <br /> <br />The City may withdraw from this Agreement by giving written notice <br />to the APCO no less than 90 days prior to the anniversary date of this <br />Delegation Agreement. The notice must include an effective date of <br />withdrawal no sooner than the anniversary date. <br /> <br /> <br />
