2. Maintenance of Ordinance's ADDroved Status <br /> <br />If changes in Regulation 13, Rule 1 are initiated by the BAAQMD which <br />would render the TRO less stringent than Regulation 13, Rule 1, then: <br /> <br />The BAAQMD shall advise the City of possible Regulation 13, Rule 1 <br />amendments at the time these amendments are drafted. <br /> <br />The City shall have one year from the date of BAAQMD adoption of <br />applicable Regulation 13, Rule 1 amendments, in which to modify the <br />TRO. <br /> <br />If amendments to the TRO are initiated by the City in response to <br />amendments to Regulation 13, Rule 1 or other reasons, and the City wishes <br />to maintain the TRO's approved status, then: <br /> <br />The City will initiate discussions with the BAAQMD to reach <br />agreement on the acceptability of the proposed amendment prior to <br />any public hearing before the City Council concerning the proposed <br />amendment. <br /> <br />The APCO shall respond to City written request for review of proposed <br />amendments to the TRO within 60 calendar days. <br /> <br />The APCO shall forward a letter to the City indicating approval or <br />disapproval of the propoled amendment and such letter shall be <br />obtained by the City prior to recommendation of approval to the City <br />'Council. <br /> <br />The City shall notify the BAAQMD in writing of any amendments <br />adopted by the City Council. If such amendments were previously <br />approved under Subsection 2.B.2. of this Agreement, the approved <br />status of the TRO will remain unchanged. <br /> <br />If the BAAQMD did not approve the amendments and determines that <br />the amended TRO is less stringent than Regulation 13, Rule 1, within <br />the meaning of Section 13-1-302 of the rule, this Delegation <br />Agreement is terminated as provided in Section 10.B. <br /> <br />Delegation Agreemen[ - Page 3 <br /> <br /> <br />
