In exchange for accepting delegation of Regulation 13, Rule 1 from the BAAQNtD, <br />the City is provided flexibility in the implementation of trip reduction requirements <br />within its jurisdiction and can minimize the inconvenience and paperwork for local <br />employers who might otherwise need to comply with both a local ordinance and the <br />District rule. As a result of implementing a delegated ordinance, the City also will <br />be directly provided with information and data that will be useful to it in its general <br />and congestion management planning. Furthermore, City with delegated programs <br />will be eligible for AB434 funding to implement and enforce their TgOs. <br /> <br />Section 40717.4(e) of the California Health and 5afety Code gives the BAAQMD the <br />authority to delegate implementation of transportation control measures, such as <br />Regulation 13, Rule 1, to any local agency if certain conditions are met. <br /> <br />Section 13-1-302 of BAAQMD Regulation 13, Rule 1 includes criteria for delegation <br />of the rule by the Air Pollution Control Officer (APCO) to City. <br /> <br />NOW, THEREFORE, the parties agree to the following: <br /> <br />Approval c~t Trio Reduction Ordinance and Delezation Plan for Rezulation 13o Rule <br />I Deleeation <br /> <br />The TRO and Delegation Plan as adopted by the City Council are attached to <br />this Delegation Agreement. The signature of Air Pollution Control Officer <br />(APCO) to th is document constitutes approval of the TRO and Delegation Plan <br />by the BAAQMD. For the purposes of this Delegation Agreement, "approved <br />status" of the TRO signifies ackno~.,ledgement that the TRO is an ordinance <br />with ~espect to air pollution control which is at least as stringent as the <br />BAAQMD's Regulation 13, gute 1, within the meaning of Section 13-1-302 <br />of the rule. Such approval exempts employers within the City from the <br />BAAQMD implementation of Regulation 13, Rule 1 pursuant to Section 13-1 - <br />105 of that rule [,except multi-jurisdiction employers as provided in Section <br />17.24.030 of the TRO]. <br /> <br />The signature of the [City Managed to this document constitutes a <br />commitment on the part of the City to implement and enforce the TRO and <br />Delegation Plan. Failure to implement and enforce the TRO or Delegation <br />Plan will result in the revocation of the approved status of the TRO and <br />Delegation Plan and this Delegation Agreement by the BAAQMD as outlined <br />in Subsection IO.B. of this Agreement. <br /> <br />Delegation Agteenlent - Page 2 <br /> <br /> <br />
