nor anyone representing him requested a modifica- tion of. the requirements of Section 2-3.40 by the Planning Commission prior to or at the time that said tentative map was considered. Thus, the map as proposed does not conform with the pro- visions of the Subdivision Ordinance of the City of Pleasanton and thus does not meet the require- ments of Section 66473 of the Government Code. 2. The City Council also finds that the proposed subdivision would violate Section 66474 (e) of the Government Code (State Subdivision *flap Act) in that the design of the subdivision and/or the proposed improvements are likely to cause sub- stantial environmental damage. The Council specif-~ ically finds that the development in question is located in a hillside area east of Foothill Road. The Director of Housing and Community Development, pursuant to the City of Pleasanton's Environmental Impact Guidelines and Procedures, determined that the project will have a significant effect upon the environment and required that an environmental impact report would be necessary. Neither the developer nor any representative of his appealed this determination to the City Council, as provided in said Guidelines. The draft environmental impact report submitted by the developer does not contain all of the elements required by the City's and State of California's guidelines and a final report was not submitted with the project at the Planninc Commission or City Council hearings.
