nor anyone representing him requested a modifica- <br />tion of. the requirements of Section 2-3.40 by the <br />Planning Commission prior to or at the time that <br />said tentative map was considered. Thus, the <br />map as proposed does not conform with the pro- <br />visions of the Subdivision Ordinance of the City <br />of Pleasanton and thus does not meet the require- <br />ments of Section 66473 of the Government Code. <br />2. The City Council also finds that the proposed <br />subdivision would violate Section 66474 (e) of the <br />Government Code (State Subdivision *flap Act) in <br />that the design of the subdivision and/or the <br />proposed improvements are likely to cause sub- <br />stantial environmental damage. The Council specif-~ <br />ically finds that the development in question is <br />located in a hillside area east of Foothill Road. <br />The Director of Housing and Community Development, <br />pursuant to the City of Pleasanton's Environmental <br />Impact Guidelines and Procedures, determined that <br />the project will have a significant effect upon <br />the environment and required that an environmental <br />impact report would be necessary. Neither the <br />developer nor any representative of his appealed <br />this determination to the City Council, as provided <br />in said Guidelines. The draft environmental impact <br />report submitted by the developer does not contain <br />all of the elements required by the City's and <br />State of California's guidelines and a final report <br />was not submitted with the project at the Planninc <br />Commission or City Council hearings.
