WHEREAS, by a settlement agreement dated November 8, 1972, and <br />exhibits thereto the boundaries of the two, aforementioned <br />service areas have been more particularly delineated and <br />the eventual phase-out of the Sunol facility is dependent <br />upon expansion of the V.C.S.D, sewage treatment plant; and <br />WHEREAS, the establishment of new discharge standards pursuant to <br />the Clean Water Act of 1970 and the Porter-Cologne Act of <br />1970, as well as action by the Environmental Protection <br />Agency to protect air quality in the Livermore-Amador Valley, <br />has resulted in a delay in implementing the expansion of <br />the V.C.S.D. facility to accommodate the Sunol plant; and <br />WHEREAS, the Regional Water Quality Control Board has imposed cease <br />and desist orders against the Sunol STP, together with <br />connections bans, especially due to odors which have emanated <br />from the plant; and <br />WHEREAS; in order to alleviate the causes for imposition of the <br />cease and desist orders, the City Council authorized and <br />improvements have been made to the plant in excess of <br />$500,000; and <br />WHEREAS, the improvements referred to above, resulted in a partial <br />lifting of the connections ban on March 18, 1975, by the <br />Regional Water Quality Control Board as to 250 single <br />family dwelling unit equivalent sewer connections; and <br />WHEREAS, the City informed the Regional Board in February of this <br />year it wished to obtain additional connections to the <br />Sunol STP; and <br />WHEREAS, the Regional Board's Executive Director prepared a staff <br />report and tentative order for the Regional Board meeting <br />of March 16, 1976, wherein the Executive Director noted that <br />"The City of Pleasanton has implemented all of the reason- <br />able odor control measures that have been identified" and <br />recommended that "the restriction on additional connections <br />to the City's sewer system should be removed if the March <br />-2- <br />
