(1) An identification of the project by its common <br /> name where possible. <br /> <br />Sec . <br /> <br />Sec . <br /> <br />Sec . <br /> <br />5.10 <br /> <br />5.11 <br /> <br />5.12 <br /> <br />(2) The decision of the decision-making body to ap- <br /> prove or carry out the project. <br /> <br />(3) <br /> <br />The determination of the decision-making body <br />whether the project in its approved form will <br />have a significant effect on the environment. <br /> <br />(4) <br /> <br />A brief statement of the mitigation measures which <br />were adopted by the decision-making body ';o reduce <br />the impacts of the approved project. <br /> <br />(5) <br /> <br />A statement that an EIR was prepared pursuant to <br />the provisions of CEQA and was certified as re- <br />quired by Section 5-7(e). <br /> <br />(6) A Statement of Overriding Considerations. <br /> <br />(b) <br /> <br />The Director shall file the Notice of Determination <br />with the county clerk of the county or counties in <br />which the project would be located. If the project <br />requires discretionary approval from a state agency, <br />the notice shall also be filed with the Secretary for <br />Resources. . <br /> <br />(C) <br /> <br />The thirty (30) day statute of limitations on court <br />challenges to the approved project, established by <br />Public Resources Code § 21167 (b), commences with the <br />filing by the Director of the Notice of Determination <br />with the county clerk of the appropriate county or <br />counties. <br /> <br />EIR Combined with Existing Planning and Review Process. <br />To the extent possible, the Director will combine the EIR <br />process with the existing planning, review, and project <br />approval process being used by the City. The Director <br />shall include the EIR as a part of the.regular project <br />report which is used in the. existing review process. An <br />opportunity for public comment should be allowed. <br /> <br />Use of Final EIR. If an EIR has been prepared by a Lead <br />Agency, other than the City of Pleasanton, the Director <br />shall obtain a copy of the final EIR and the appropriate <br />decision-making body shall consider the Lead AgenCy's final <br />EIR before acting upon or approving the project subject to <br />said EIR. <br /> <br />Limitations on Local Responsible Agencies. In applying the <br />duty to mitigate or avoid significant effects on the environ- <br />ment whenever it is feasible to do so, the scope of concern <br />of a local agency which is functioning as a Lead Agency <br />shall differ from that of a local agency which is function- <br /> <br /> <br />
