Sec. <br /> <br />Sec . <br /> <br />5-9 <br /> <br />(e) <br /> <br />Certification of Final EIR. The final EIR shall be <br />presented to the decision-making body of the Lead Agency. <br />The City shall certify that the final EIR has been com- <br />pleted in compliance with CEQA and the state guidelines <br />and that the decision-making body or administrative <br />official having final approval authority over the pro- <br />Ject has reviewed and considered the information con- <br />tained in the EIR prior to the approval of the project. <br /> <br />Findings. <br /> <br />(a) <br /> <br />The City shall not approve or carry out a project for <br />which an Environmental Impact Report has been completed <br />which identifies one or more 'significant effects of the <br />project unless the approving body makes one or more of <br />the following written findings for each of those sig- <br />nificant effects, accompanied by a statement of the <br />facts supporting each finding. <br /> <br />(1) <br /> <br />Changes or alterations have been required in, or <br />incorporated into, the project which mitigate or <br />avoid the significant environmental effects there- <br />of as identified in the final EIR. <br /> <br />(2) <br /> <br />Such changes or alterations are within the respon- <br />sibility and Jurisdiction of another public agency <br />and not the City. Such changes have been adopted <br />by such other agency or can and should be adopted <br />by such other agency. <br /> <br />(3) <br /> <br />Specific economic, social, or other considerations <br />make infeasible the mitigation measures or project <br />alternatives identified in the final EIR. <br /> <br />(b) <br /> <br />(c) <br /> <br />The findings required by subsection (a) shall be sup- <br />ported by substantial evidence in the record. <br /> <br />The finding in subsection (a)(2) shall not be made if <br />the agency making the finding has concurrent Jurisdic- <br />tion with another agency to deal with identified <br />feasible mitigation measures or alternatives. <br /> <br />(d) <br /> <br />The findings refered to in subsection (a), above, shall <br />be set forth in a document entitled Statement of Over- <br />riding Considerations. <br /> <br />Notice of Determination. <br /> <br />(a) <br /> <br />After approving a project for which an EIR has been <br />prepared, the Director shall file a Notice of Determin- <br />ation.
