(f) <br /> <br />A~ppeal. Any person may appeal to the City Council the <br />determination of the approving body that ,a negative <br />declaration is appropriate for a particular project. <br />Said appeal shall be in writing, it shall specify with <br />Particularity the reasons for the appeal and shall be <br />filed, together with any established filing fee, with <br />the City Clerk within the time period provided in the <br />municipal code for appealing decisions of the approving <br />body. <br /> <br />In making its determination regarding the aPpropriate- <br />ness of a Negative Declaration, the reviewing body <br />shall be guided by the principles relating to NegatiVe <br />Declarations and Environmental Impact Reports as set <br />forth in these Guidelines. ' <br /> <br />(g) Notice of Determination. <br /> <br />(3) <br /> <br />(1) <br /> <br />(2) <br /> <br />After making a decision to carry out or approve <br />a project for which a Negative Declaration has <br />been prepared, the Director shall file a Notice <br />of Determination with a copy of the Negative <br />Declaration attached. <br /> <br />The Notice of Determination shall include: <br /> <br />(A) The decision of the agency to approve or <br /> disapprove the project. <br /> <br />(B) <br /> <br />(c) <br /> <br />The determination of the agency whether the <br />project will have a significant effect on <br />the environment, and <br /> <br /> A statement that no EIR has been prepared <br /> pursuant to the provisions of CEQA. <br /> <br />The Director shall file the Notice of Determina- <br />tion with the county clerk of the county or <br />counties in which the project will be located. <br />If the project requires discretionary approvals <br />from a state agency, the Notice of Determination <br />also shall be filed with the Secretary for Re- <br />sources. <br /> <br />(4) <br /> <br />The thirty (30) day statute of limitations on <br />court challenges to the approved project, estab- <br />lished by Public Resources Code § 21167(b), <br />commences with the filing by the Director of the <br />Notice of Determination with the County Clerk <br />of the appropriate county or counties. <br /> <br />-24- <br /> <br /> <br />
