(f) A~ppeal. Any person may appeal to the City Council the determination of the approving body that ,a negative declaration is appropriate for a particular project. Said appeal shall be in writing, it shall specify with Particularity the reasons for the appeal and shall be filed, together with any established filing fee, with the City Clerk within the time period provided in the municipal code for appealing decisions of the approving body. In making its determination regarding the aPpropriate- ness of a Negative Declaration, the reviewing body shall be guided by the principles relating to NegatiVe Declarations and Environmental Impact Reports as set forth in these Guidelines. ' (g) Notice of Determination. (3) (1) (2) After making a decision to carry out or approve a project for which a Negative Declaration has been prepared, the Director shall file a Notice of Determination with a copy of the Negative Declaration attached. The Notice of Determination shall include: (A) The decision of the agency to approve or disapprove the project. (B) (c) The determination of the agency whether the project will have a significant effect on the environment, and A statement that no EIR has been prepared pursuant to the provisions of CEQA. The Director shall file the Notice of Determina- tion with the county clerk of the county or counties in which the project will be located. If the project requires discretionary approvals from a state agency, the Notice of Determination also shall be filed with the Secretary for Re- sources. (4) The thirty (30) day statute of limitations on court challenges to the approved project, estab- lished by Public Resources Code § 21167(b), commences with the filing by the Director of the Notice of Determination with the County Clerk of the appropriate county or counties. -24-
