(d) <br /> <br />(e) <br /> <br />(3) <br /> <br />(4) <br /> <br />(5) <br /> <br />A copy of the Negative Declaration s~all be <br />distributed to any person or organization who <br />has requested in writing that he be notified or <br />the action of the Director. <br /> <br />For projects requiring the Publication of notices <br />according to law (e.g. rezonings, variances, con- <br />ditional use permits) notice of Preparation of the <br />Negative Declaration shall be published in the <br />official newspaper of thyCity at least once during <br />said ten (10) day posting period, the costs of <br />PUblication to be paid by the permit applicant as <br />an additional permit fee. This publication can be <br />combined with any other publication of the project <br />otherwise required by law. <br /> <br />For projects not requiring the publication of <br />notices required by law (e.g. minor subdivisions, <br />design review) the Director, or his designated re- <br />Presentative, shall mail notices of the preparation <br />of the Negative Declaration to contiguous property <br />owners and other property owners in the vicinity <br />of the project who would be affected, in the opinion <br />of the Director or his representative, by the <br />project. <br /> <br /> Public Review. Within the time period specified in <br /> subsection (c) any member of the public may file <br /> written comments to the proposed Negative Declaration. <br /> These written comments shall be submitted, together <br /> with responses from the Director, to the approving <br /> body for ts consideration prior to reviewing the <br /> Negative Declaration and passing upon the project. <br />The approving body may also afford an opportunity <br />for the public to comment on the Negative Declaration <br />at the time of consideration of the project. Any <br />meeting of the approving body may be continued for <br />a reasonable period of time in order to allow the <br />Director to respond to .any written comments received <br />within the time period specified above, or any oral <br />and/or written comments received at the approving <br />body's meeting. <br /> <br />Approval. The approving body, after receiving the <br />proposed Negative Declaration, public input and staff <br />comments, shall review the Provisions of these Guide- <br />lines as they pertain to the requirements for Negative <br />Declarations and Environmental Impact Reports. The <br />approving body shall determine if a Negative Declara- <br />tion is appropriate and what mitigation measures must, <br />if any, be undertaken to insure that the project will <br />not have a significant effect upon the environment. <br /> <br />-23- <br /> <br /> <br />
