(d) (e) (3) (4) (5) A copy of the Negative Declaration s~all be distributed to any person or organization who has requested in writing that he be notified or the action of the Director. For projects requiring the Publication of notices according to law (e.g. rezonings, variances, con- ditional use permits) notice of Preparation of the Negative Declaration shall be published in the official newspaper of thyCity at least once during said ten (10) day posting period, the costs of PUblication to be paid by the permit applicant as an additional permit fee. This publication can be combined with any other publication of the project otherwise required by law. For projects not requiring the publication of notices required by law (e.g. minor subdivisions, design review) the Director, or his designated re- Presentative, shall mail notices of the preparation of the Negative Declaration to contiguous property owners and other property owners in the vicinity of the project who would be affected, in the opinion of the Director or his representative, by the project. Public Review. Within the time period specified in subsection (c) any member of the public may file written comments to the proposed Negative Declaration. These written comments shall be submitted, together with responses from the Director, to the approving body for ts consideration prior to reviewing the Negative Declaration and passing upon the project. The approving body may also afford an opportunity for the public to comment on the Negative Declaration at the time of consideration of the project. Any meeting of the approving body may be continued for a reasonable period of time in order to allow the Director to respond to .any written comments received within the time period specified above, or any oral and/or written comments received at the approving body's meeting. Approval. The approving body, after receiving the proposed Negative Declaration, public input and staff comments, shall review the Provisions of these Guide- lines as they pertain to the requirements for Negative Declarations and Environmental Impact Reports. The approving body shall determine if a Negative Declara- tion is appropriate and what mitigation measures must, if any, be undertaken to insure that the project will not have a significant effect upon the environment. -23-
