Sec . <br /> <br />See . <br /> <br />Sec. 5.7 <br /> <br />Decision to Prepare an EIR. <br /> <br />(a) <br /> <br />If the Director, or any reviewing body, finds after <br />an Initial Study that the project may have a significant <br />effect on the environment, the City must prepare or <br />cause to be prepared an Environmental Impact Report. <br /> <br />(b) <br /> <br />An EIR should be prepared whenever it can be fairly <br />argued on the basis of substantial evidence that the <br />project may have a significant effect on the environ- <br />ment. <br /> <br />(C) <br /> <br />An EIR should be prepared when there is serious public <br />controversy concerning the environmental effect of a - <br />project. Controversy not related to an environmental <br />issue does not require the preparation of an EIR. <br /> <br />Appeal. Any person may appeal to the City Council the deter- <br />mination of the Director that an Environmental Impact Report <br />is appropriate for a particular project. Said appeal shall <br />be in writing, it shall specify with particularity the <br />reasons for the appeal, and shall be filed, together with <br />any established filing fee, with the City Clerk within the <br />time provided in the Municipal Code for appealing decisions. <br /> <br />In making its determination regarding the appropriateness <br />of an Environmental Impact Report the City Councilshall be <br />guided by the principles relating to Negative Declarations <br />and Environmental Impact Reports as set forth in these <br />Guidelines. <br /> <br />The City Council shall render its decision within forty-five <br />(45) days of receipt of the appeal unless a continuance is <br />granted by the appellant. <br /> <br />EIR Preparation. When an agency decides that an EIR will <br />be required for a project, it shall follow the procedures <br />contained in this section. <br /> <br />(a) Early Consultation. <br /> <br />Before completing a draft EIR consisting of the <br />information specified in Section 7.1, 7.2, 7-3 <br />and 7.4 of these Guidelines, the Director shall <br />consult with all Responsible Agencies pursuant <br />to Section 4.7. In addition, if the Director <br />has not already done so, the Director should <br />also consult directly with any person or organi- <br />cation which the Director believes will be <br />concerned with the environmental effects of the <br />project. <br /> <br />-25- <br /> <br /> <br />
