1 3 4 5 8 9 10 11 15 14 15 17 18 19 SO S4 maintenance of those facilities of the Authority used to transport, dechlorinate, and discharge Agency's treated wastewater flow to the Authority system, Agency shall pay Authority for its proportionat~ share of said maintenance and opera- tion costs, including allocated administration costs, repair costs and outfall .discharge monitoring costs, in accordance with the schedule which sets forth the amount of the costs due from the Agency and the manner of payment from the Agency, which schedule is identified as Exhibit'B' attached hereto and made a part hereof as though fully set forth herein. 4. Present and Future' Capacity Rights: Agency has purchased, pursuant to paragraph 2, above, discharge rights in Authority's project north of Oro Loma Pump Station for 15.62 million gallons per day (MGD) average flow for the maximum month. In addition, Agency and Authority recognize that Agency has purchased by payments made under paragraph 2, above,. reserved capacity in Authority's project north of the Oro Loma Pump Station fo~ peak flow and future industrial (including noneretail commercial) uses by Agency's present members. Said reserve capacity, equivalent to 20% of the initial 15.62 MGD usage, shall be utilized by Agency at Agency's option upon providing prio~ written notice to Authority of Agency's intention to utilize any or all of said reserve except that short-term peak wet'weather flows within said 20% reserve capacity, will not require prior written notice. Authority shall not do anything within Authority's control which would injure or prohibit Agency~from utilizing the capacity set forth herein. If Authority desires to utilize any or all of Agency's capacity, Authority shall submit a written proposal to Agency detailing the' nature, duration and volume of said usage. Agency may give its written permission, subject to any conditions negotiated by the parties for usage of Agency's capacity by Authority. The -4-
