1 <br /> <br />5 <br /> <br />4 <br /> <br /> 5 <br /> <br /> 7 <br /> <br /> 8 <br /> <br /> 9 <br /> <br />10 <br /> <br />11 <br /> <br /> 14 <br /> <br /> 17 <br /> <br /> 18 <br /> <br /> 19 <br /> <br /> ~0 <br /> <br /> ~5 <br /> <br />and south of the Marina Outfall and to discharge its treated wastewater in and <br />through said interceptor line subject to the hereinafter conditions, promises,' <br />and costs. <br /> <br /> That it is anticipated that AgeAcy's facilities must necessarily traverse <br />the jurisdictions of Oro Loma Sanitary District and Castro Valley Sanitary <br />District; that both of these Districts are two of the political subdivisions <br />that comprise the Authority; that Agency hereby agrees, that in the construction <br />of Agency's facilities, such construction will be done in such a manner as to <br />avoid or minimize disruption of service provided by each of said Districts, <br />Agency shall promptly make any repairs or replacements to said District's <br />facilities necessitated by Agency's construction activities in conformance with <br />the standards, procedures, and specifications of the District having jurisdic- <br />tion, and that said Districts will not incur costs for re!ocation of their <br />facilities or for any damages sustained by said DistriCts as a result of'the <br />installation o~ operation of Agency's facilities. <br /> <br /> 2. Initial Costs: TO accon~nodate the addition of Agency's treated waste- <br /> water flow to Authority's project, Authority (with the assurance of available <br /> State funds for payment of Agency's incremental share of project costS) incurred, <br /> or will incur, certain engineering, construction, legal, administration and <br /> miscellaneous costs in.oversizing its pipeline north of the Oro toma Pump <br /> Station. A fair and equitable share of project developmen~ costs and charges <br /> for perpetual capacity rights to discharge to the Authority project as outlined <br /> in paragraph 4, shall be paid by Agency to Authority in the amount and manner <br /> set forth in Exhibit 'A', attached hereto and made a part hereof as though <br /> fully set forth herein. <br /> <br /> 3.
