Franciso Bay; and <br /> <br /> WHEREAS, Agency and Authority have caused to be prepared a "joint Use <br /> Outfall Study" which has studied the effects of including Agency's flow into <br /> the Authority's facilites; and <br /> <br /> WHEREAS, Authority caused design plans to be prepared for that portion of <br /> its project which would carry the effluent from Agency's project when payment <br /> to Authority of Agency's incremental share of the costs for said plans was <br /> assured by the State Water .Resources Control Bo'ard by'Resolution No. 77-19, <br /> adopted on March 17, 1977; and <br /> <br /> WHEREAS, due to grant conditions imposed by the State Water Resources <br /> Control Board, Authority sized certain portions of its project tO accommodate <br /> Agency's flows based upon information which was then available to Authority <br /> regarding Agency's possible needs; and <br /> <br /> WHEREAS, once Agency determined to construct a project which would be <br /> <br />'combined with Authority's project, the'size of Agency's basic project did not <br /> require the total capacity constructed f~r Agency's benefit in Authority's <br /> project; and <br /> <br /> WHEREAS, Agency must pay Authority for that portion of the costs of <br /> Authority's project attributable to Agency, thus providing Agency with capacity <br /> in said project for Agenc~'s use as it deems proper; and <br /> <br /> WHEREAS, Agency and Authority desire to establish a-reasonable method for <br /> the participation by Agency in the use of the physical facilities of the <br /> Authority; <br /> <br /> NOW, THEREFORE, the parties agree as follows: <br /> <br /> 1. Authority authorizes AgenCy to connect to its physical facility gener- <br /> ally along its interceptor line north of the proposed Oro Loma Pump Station <br /> <br /> <br />
