requirements imposed upon Authority at its point of discharge and in the <br />receiving waters, as well as any NPDES permit requirements imposed directly <br />upon Agency by the appropriate regulatory agency; except that Authority shall <br />perform the dechlorination aspects of treating said wastewater in order to <br />meet the dechlorination requirements imposed by both federal and state agencies. <br />Agency shall maintain a minimum of 1 mg/1 of chlorine residual at the sampling <br />station described in paragraph 7 herein unless notified by the Authority that <br />a lesser amount is acceptable. <br /> <br /> lO. Failure to Meet Discharge Requirements: Agency shall hold Authority <br /> harmless from all liability and/or damages incurred by said Authority as a <br /> direct and proximate result of any failure by Agency to meet the discharge <br /> requirements specified in paragraph 9, including but not limited to, legal, <br /> engineering, and administrative expenses, fines and damages incurred by the <br /> Authority as a result of the cease and desist order or court injunction from <br /> any federal, state or regional agency. restricting Authority. Upon notification <br /> of each violation, the Agency shall take prompt, corrective action as necessary <br /> to meet said discharge requirements. <br /> In the event that Agency is made responsible for any f.ines or sanctions <br /> imposed due to the failure of the AuthOrity to meet required discharge require- <br /> ments, Authority shall hold Agency free and harmless from liabilities and/or <br /> damages incurred by it, which damages are the direct and proximate result of a <br /> violation by Authority and sai~ damage's shall include, but not be limited to, <br /> legal, engineering, administrative expenses, fines and damages incurred by <br /> Agency as a result of any cease and desist orderor court injunction from any <br /> federal,,state or regional agency restricting Agency. Upon notification, <br /> Authority shall take prompt and corrective action as may be necessary to meet <br /> <br />-8- <br /> <br /> <br />
