Section 5. <br /> <br />Resolution No. 76-163 is hereby repealed as are any other resolu- <br />tions predating this resolution which pertain to wage and fringe <br />benefit provisions for management and confidential employees, except <br />for Resolution No. 77-171, and Resolutions pertaining to wage and <br />fringe benefits for the City Manager and City Attorney. <br /> <br />Section 6. <br /> <br />Except as provided herein to the contrary the terms and provisions <br />of this Resolution shal. 1 not effect the applicability of the Personnel <br />Rules of the City of Pleasanton to confidential and management employees <br />who are not exempt from said Rules. <br /> <br />Section 7. <br /> <br />The wages and fringe benefits set forth in this Resolution shall be the <br />only compensation for the positions set forth in Exhibits A and B hereto <br />and there shall be no right to receive benefits contained in any <br />Memoranda of Understanding with the City's recognized employee organi- <br />zations which are not included in the wages and benefits set forth <br />herein. It is the City Council's intention that there shall be mutual <br />exclusivity between the compensation plans set forth in this Resolution <br />and the items contained in negotiated Memoranda of Understanding, except <br />as one is specifically included in the other. <br /> <br />Section 8. <br /> <br />If any section, subsection, subdivision, paragraph, sentence, clause, <br />or phrase of this Resolution or any part thereof is for any reason held <br />to be unconstitutional, such decision shall not affect the validity of <br />the remaining portions of this Resolution or any part thereof. The <br />City Council hereby declares that it would have passed each section, <br />subsection, subdivision, paragraph, sentence, clause or phrase thereof, <br />irrespective of the fact that any one or more sections, subsections, <br />subdivisions, paragraphs, sentences, clauses or phrases be declared <br />unconstitutional. <br /> <br />Section 9. This Resolution shall become effective upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED ON AUGUST 23, 1977 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers ~ He~lihy, LeClaire, Mercer and Mayor Philcox <br /> <br />NOES: None <br /> <br />ABSENT: Councilmember Brandes <br /> <br />ATTEST: <br /> <br />APPROVED AS TO FORM: <br /> <br /> g <br />City Attorney <br /> <br /> <br />
