AGREEMENT IN SETTLEMENT OF LITIGATION <br />IAFF, LOCAL 1974 v. CITY OF PLEASANTON <br /> 1 CIVIL 36270 <br /> <br /> THIS AGREEMENT is entered into this 10th day of October , 1977, <br />by and between the INTERNATIONAL ASSOCIATION OF FIREFIGHTERS, LOCAL <br />1974 (hereinafter referred to as "Union"), and the CITY OF PLEASANTON <br />(hereinafter referred to as "City"); <br /> <br /> WHEREAS, City adopted Resolution No. 73-111 on June 25, 1973, <br />unilaterally changing certain aspects of the Personnel Rules of the <br />City of Pleasanton and designating Fire Captains and Fire Prevention <br />Officer as Management Employees; and <br /> <br /> WHEREAS, Union filed suit against City to enjoin enforcement <br /> <br />of the aforementioned resolution without meeting and conferring on <br />the subject matter set forth therein; and <br /> <br /> WHEREAS, a judgment was rendered on January 10, 1974, granting <br />the Union's requested injunction on some items and denying said <br />injunction as to other items; and <br /> <br /> WHEREAS, Union appealed said decision to the Court of Appeal, <br />First Appellate District; and <br /> <br /> WHEREAS, on April 2, 1976, the Fourth Division Of the First <br />Appellate District ruled in IAFF Local 1974 v. City of Pleasanton, <br />1 Civil 36270, overruled the determination of the trial court that <br />certain items set forth in Resolution No. 73-111 were not subject <br />to negotiation between the parties; and <br /> <br /> WHEREAS, Union and City have met and conferred as provided in <br />the Meyers-Milias-Brown Act (Government Code Sec. 3500, et seq.) <br />regarding the contents of Resolution No. 73-111 which were litigated <br />above; and <br /> <br /> <br />
