Section 20. Promotion <br /> <br />Promotional or open-promotional examinations may be <br />conducted whenever in the opinion of the Personnel <br />Officer, the needs of the service require. Only <br />employees who meet the requirements set forth in the <br />examination announcements may compete in promotional <br />examinations. <br /> <br />Insofar as consistent with the best interests of the <br />department as determined by the City Manager vacancies <br />in the department shall be filled by promotion from <br />within the department after a promotional examination <br />has been given and a promotional list established. <br /> <br />Upon completion of all promotional testing, the names of <br />the persons having the highest three (3) scores On the eli- <br />gibility list shall be submitted to the Fire Chief <br />for his/her consideration. <br /> <br />An employee meeting the minimum qualifications may be <br />temporarily promoted to an authorized position on an <br />"acting" basis. The employee temporarily promoted shall <br />be paid the minimum rate for the position to which he/she <br />is promoted except that said rate shall be at least <br />five percent (5%) above his/her regular rate of pay. <br />The employee so promoted shall continue to receive this <br />higher rate of pay until such time as the position is <br />filled on a full-time basis. <br /> <br />If, in the opinion of the Personnel Officer, a vacancy <br />in the department could be filled better by an open- <br />competitive examination instead of promotional examina- <br />tion, he/she shall arrange an Open-competitive employment <br />list consistent with the Personnel Rules. <br /> <br />Section 21. Resignation, Reinstatement and Layoff <br /> <br />21.1 Automatic Resignation <br /> <br />Failure to return at the expiration of a leave of absence <br />or being absent without leave shall be considered an <br />automatic resignation. Such a resignation may be <br />rescinded by the City Manager if the employee submits <br />satisfactory reasons for his/her absence within three (3) <br />calendar days Of the date his/her resignation was effected. <br /> <br />21.2 Voluntary Resignation <br /> <br />An employee may resign in good standing by submitting <br />to the Fire Chief and Personnel Officer a written resig- <br />nation stating the reasons therefor and effective date <br />thereof at least two (2) weeks prior thereto. <br /> <br />A statement as to the resigned employee's performance <br />shall be forwarded to the Personnel Officer by the <br />Fire Chief. <br /> <br />21.3 Reinstatement <br /> <br />With the approval of the Personnel Officer, an employee <br />who has resigned in good standing may be reinstated <br />within two (2) years Of the effective date Of resignation, <br />to a vacant position in the same or comparable class. <br />Upon reinstatement, the employee, for all purposes, <br />shall be considered as though he had received a new <br />appointment. <br /> <br />-16- <br /> <br /> <br />
