21.4 Layoff <br /> <br />The Appointing Authority maylay off an employee because <br />of material changes in duties, organization or shortage <br />of work or funds. <br /> <br />The employee having the least length of total continuous <br />service with the department in classification in which <br />the Appointing Authority is laying off shall be laid <br />off first. <br /> <br />Employees scheduled to be laid off may, however, displace <br />the least senior employee in the next lower paying classi- <br />fication of like work who has less seniority. <br /> <br /> Employees laid off or who through displacement have <br /> changed classification shall have their name placed <br /> upon a re-employment list in seniority order. The <br /> employee with the highest senoriity on a re-employment <br /> list for a particular classification when a vacancy <br /> exists in that classification shall be offered the <br /> appointment. No name shall be carried on a re-employment <br /> list for a period longer than one (1) year from the date <br /> of lay off from City service or change of classification <br /> through displacement. <br /> <br />Section 22. Discipline <br /> <br /> The City has the right to discipline, demote, or <br /> discharge employees for cause. <br /> <br />Section 23. Grievances <br /> <br />23.1 <br /> <br />23.2 <br /> <br />A grievance is any dispute which involves the inter- <br />pretation or application of any provision of this <br />Memorandum of Understanding excluding, however, those <br />provisions of this Memorandum of Understanding which <br />specifically provide that the decision Of any City <br />official shall be final, the interpretation or application <br />of those provisions not being subject to the grievance <br />procedure. <br /> <br />Grievances shall be processed in the following manner: <br /> <br /> (1) Any employee who believes that he/she has a <br /> grievance may discuss his/her complaint with such <br /> management Official in the department in which <br /> he/she works as the Fire Chief may designate. <br /> If the issue is not resolved within the department, <br /> or if the employee elects to submit his/her grievance <br /> directly to the Union, the procedures hereinafter <br /> specified may be invoked. <br /> <br />(2) Any employee or any official of the Union may <br /> notify the Personnel Officer in writing that a <br /> grievance exists, stating the particulars of the <br /> grievance and, if possible, the nature Of the <br /> determination desired. The Personnel Officer shall <br /> have fourteen (14) days in which tc investigate the <br /> issues, meet with the complainant and attempt to <br /> reach a satisfactory resolution of the problem. No <br /> grievance may be processed under paragraphs (3) and <br /> (4) below which has not first been filed and investi- <br /> gated in accordance with this paragraph (2). <br /> <br /> (3) Any grievance which has not been resolved by the <br /> procedures hereinabove set forth may be referred to <br /> the City Manager by the complainant or by the <br /> <br />-17- <br /> <br /> <br />
