4. SEWER SERVICE. City agrees that pending annexation <br />to City of the land of Owner to furnish to Owner sanitary sewer <br />services, to the extent authorized by the Regional Water Pollution <br />Control Board, and Owner agrees to pay in return for said services <br />the following charges: <br /> <br />(a) <br /> <br />The normal City Connection fee for connection <br />to the sewer system, in accordance with <br />applicable City ordinances that become effective <br />prior to connection to the sewer system. <br /> <br />(b) <br /> <br />An amount computed in accordance with the City <br />formula which is sufficient to amortize Owner's <br />pro rata share of the cost of construction of <br />the Del Valle Interceptor Sewer. <br /> <br />(o) <br /> <br />A monthly sewer service charge as is now or may <br />hereafter be specified by ordinance. <br /> <br /> 5. ANNEXATION FEE. When the land of Owner is annexed to <br />City and in consideration and part payment for City-owned facilities <br />located both in and out of the original City Boundaries, Owner shall <br />pay to City an annexation fee as follows: <br /> <br /> TWO HUNDRED DOLLARS ($200.00) for each acre or <br /> portion thereof of Owner's property as described <br /> in Exhibit A, attached hereto. <br /> <br /> 6. BONDED DEBT. Owner does hereby consent that, upon <br />annexation of his property to City, said property shall be taxed <br />to pay its share of existing bonded indebtedness of City. This <br />agreement shall serve as such consent, and a copy shall be filed <br />with the Treasurer-Tax Collector of Alameda County, if evidence <br />of such consent is required; provided, however that Owner's property <br />will be excluded from the City bonded debt existing on the.effective <br />date of this agreement and from and after the annexation of his <br />property to City for all utility facilities to which Owner's <br />property is not connected. <br /> <br /> 7. TAXES. Owner understands that after annexation has been <br />completed said property shall be subject to all real property <br />taxes. <br /> <br /> 8. ASSESSMENT DISTRICTS. Owner agrees to cooperate fully <br />with City in the formation of any mutual benefit districts or <br />assessment districts which City deems necessary for the installation <br />of public improvements. <br /> <br />-2- <br /> <br /> <br />
