SEWER FACILITIES AND PRE-ANNEXATION AGREEMENT <br /> <br />THIS AGREEMENT made and entered at Pleasanton, California <br /> <br />this <br /> <br />, by and between: <br /> <br />THE CITY OF PLEASANTON, a general law City, <br />with offices at 200 Bernal Avenue, Pleasanton, <br />Alameda County, California, hereinafter referred <br />to as "City," <br /> <br />and <br /> <br />EDWARD P. SHANNON AND WILMA H. SHANNON, <br />hereinafter referred to as "Owner," <br /> <br />subject to the following terms and conditions: <br /> <br />WITNESSETH: <br /> <br /> 1. RECITAL. Owner controls land within the General Plan <br />area of City and desires to bring these lands within the jurisdiction <br />of. City. The land of Owner is not contiguous to the boundaries <br />of City, thus requiring annexation of intervening land, together <br />with that of Owner in order to avoid creation of an island of <br />incorporated territory. The owners of intervening land are not <br />sufficiently willing to annex to City at this time. Therefore, <br />annexation of the land of Owner to Pleasanton is not at present <br />feasible. <br /> <br /> 2. CONSIDERATION. The City agrees to consider future <br />annexations to the City of Pleasanton, and Owner agrees to co- <br />operate fully in such annexation of that land controlled by Owner <br />lying within Pleasanton Township, Alameda County, California. <br />Owner and City agree that the provisions of this contract, the <br />State laws, and City ordinances and resolutions shall control the <br />responsibilities of both parties. <br /> <br /> 3. LAND AREAS. The land affected by this agreement shall be <br />designated as follows: <br /> <br />(a) <br /> <br />Land of Owner more particularly described in <br />the legal description and map attached hereto <br />as Exhibit A and made a part hereof. <br /> <br />(b) <br /> <br />The land described in Exhibit A is developed <br />with one residential structure. This agreement <br />is limited to one (1) dwelling unit only. <br /> <br /> <br />
